My husband just had an interview and everything was fine except that he needs to apply for a waiver :((((( so sad i havent seen him for a year....

he entered the US with a fake passport(not his) and he applied for asylum a little more than a year after his entrance.... he got denied so he is currently in albania.......

now he has to apply for the I601 does anyone know how long it takes?

if it takes too long i will go and stay with him ..... i cant staY here on my own anymore.....

please if anyone knows any info i would reaalllyyy appreciate it

If it was a fake Albanian passport he was charged with misrepresentation which can be difficult to overcome.

Waiver adjudication usually takes a long time.

You also need to be 100% sure you have a very good understanding of the requirements for the hardship letter -- you need to prove extreme hardship and provide serious and detailed evidence.

Start by reading www.immigrate2us.net in the 601 forum or family based immigration dot com (all one word) in the waiver forum

Right, but he entered with someone else's passport which is defined as misrepresentation (as opposed to someone who illegally crossed a border and accumulated illegal presence). The first thing you have to do is research the hardship letter and waiver process. It takes a lot of work to put together a strong letter with sufficient evidence. Before you make a decision on whether to stay or go, start researching. The sooner you submit the letter and waiver, the sooner it will be adjudicated. Start by reading everything on immigrate2us.net as well as attorney Laurel Scott's 601 guidance memo here: http://www.visacentral.net/I601Memo.pdf. I would also strongly recommend a phone consult with her or another qualified attorney who is experienced in waivers.

I find it hard to believe that any Albanian passort would be much of an advantage.

We need more detail, which country, when etc.

this happened in 2001 and was in proceedings until 2006 and his lawyer advised him to go back......

i got in contact with his old lawyer and told me that it would be a lil over $5000

in fact he did not make the extreme hardship so important...... and as a matter of fact the only hardship that i have is emotional and financial...... no illness or anything

i am sooo confused about everything

You really need to take a step back and start doing some research. Emotional doesn't count for anything but there are many, many other strong points you can make. You start by thinking about each and every way you life would change if you had to relocate permanently to his country. Safety, security, your education, your health, employment (of lack of), language problems, being separated from your family, losing your health insurance, retirement savings, social security, home, etc. Proof of extreme hardship is the key, vital part of the waiver process. If your lawyer says otherwise, dump him and consult with someone who is experienced in waivers.
