I am the petitioner for a fiancé visa 129f. I mistakenly answered question 4a no. It asks if you have ever been arrested or convicted. I misread it. I understand if I had checked yes and provided court records this would not have been an issue. But I checked no and filed it 3 days ago. Will I be denied or will they allow me to explain if they see it on the background check?

I think it could go either way.  I have seen RFEs at the USCIS level, and I know of one case which was denied after the interview at the consulate.   Other members might have thoughts, too.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

 Can you try to get ahead of it? Once you get a receipt number, and it’s in CA(likely location), copy that page with the correct answer, including supporting documentation, send it. I’d try to do something like that if it’s a potential biggie, put the receipt number on everything.

 

  It’s not like you’re just off a few months with time at a residence. It seems to me that is likely to cause an issue down the road. Even as a simple RFE, may as well try to get ahead of it. JMHO.
