When to update I-864 (change of financial info) please advise (Merged).

Hey All,

 

We got DQ'd for IR1 June 2023 and are hopeful we'll be scheduled for an interview at the USEM soon now that there are reported movements in the CR1/IR1 backlog. At the time of filing (2021), my income qualified as a solo sponsor. However, I lost my job last year and currently have no regular US income to show since I'm in the Phils and getting by with gigs on Fiverr. I'm hoping my wife and I could fly back to the US together on her IR1 visa. I filed my 1040 for 2023 last week and my income unfortunately is below the poverty guidelines. My Dad has agreed to be a joint sponsor and his income more than meets the requirement. From what I understand, I will have to submit a new I-864 showing my current income. I've been waiting to update it because I'm hoping I could at least find a work-from-home job from the US while waiting here so that I have a current paystub but haven't had any luck since most of the jobs I've found send their own equipment for work.

 

Question: At what point do I submit a new I-864 for myself and upload the I-864 of the sponsor? I read some posts that mentioned uploading new docs to CEAC will "reset" the timeline. Trying to avoid doing something at this point that might cause more delay to the interview schedule. It took about a year for us to hear from NVC that we were DQ'd. This visa process has been a long and trying one, can't wait to go back to the US with my wife and establish our life there together. Looking forward to helpful advice for my situation.

Why would you update it? I don't think they would request more current info until after 4/15.

 

Why did you even file, you should have waited til after the interview.

I'm assuming it has to be updated since the information provided about my employment at the time of filing is no longer true at present and I wouldn't want my wife to lie to the CO at the interview if asked about it. Besides, I don't have proof of current income to show if the CO were to ask for one. I think the best route to take at this point would be to have a joint sponsor. I just need guidance as to when the right time would be to upload the co-sponsor's docs to CEAC.

You can wait until you have the interview scheduled and then upload the new I864's.  Also if your father is married, you may want their spouse to also fill out an I864A in case the consulate asks for it.

Exactly.  Wait until you have the interview scheduled.  Somebody mentioned them asking.  They won't until the interview, but do it before anyway.  Before interview but after you have the interview letter.

If the poverty guidelines change between the time the petitioner signed the Affidavit of Support and the issuance of an immigrant visa, must the petitioner/sponsor and joint sponsor, if required, submit a new Form I-864?

No, the Form I-864 remains valid indefinitely unless evidence of failure to meet the poverty guidelines in effect on the date of I-864 filing arises. The consular officer will determine whether the income claimed by the sponsor and documented with financial evidence meets the poverty guidelines in effect at the time the I-864 was filed. If the income claimed does not meet the poverty guidelines, then the consular officer may request that the sponsor submit current year income information.

 

In other words wait till the interview. Otherwise you are probably just creating more headaches for yourself.

While the submitted form remains valid, certain changes can disqualify the sponsor.  Consular Officers very commonly ask for updated affidavits and supporting documentation. Not having already uploaded an updated affidavit, when there are significant changes, can cause delays of several weeks or months in visa issue.  That's why I gave the advice I gave.  It's based on current and past actual knowledge.  OP is wise to follow the advice already given.

Option 1. Don't do a new I- 864 but rather Add you dad as a join sponsor . Let your dad upload form I-864 including tax return. Adding any material to the already summited documents does not change/ affect your waiting time.  The NVC works with priority dates.  You can not add any document when they schedule you for an interview. Most people here don't know what they are talking about. 

Option 2. Let your dad filled form I- 864 as a joint sponsor . Wait for your interview date and bring the form with you to the interview just incase.

Hey all,

 

I logged in to CEAC to upload an updated I-864 for me (as my financial situation has changed) and upload the I-864 & supporting docs of the joint sponsor but I don't see anywhere on the page where we can add a joint sponsor. Instead, this is what it says about making changes, which in our situation would be #2. I might have been misinformed, I was under the impression that we could upload documents (including adding a joint sponsor) to CEAC up until the interview date. Wife's interview is on Thursday, did I mess up by waiting until we had the interview date before doing this? NVC has not advised us to come up with a joint sponsor, it's just that my income last year fell below the requirement so we have a joint sponsor ready because of that. Please advise, what should we do at this point? Trying to avoid anything that might delay the process.
