Though he can wait in the US while I-601 A is pending…once he goes out they will refuse on public charge grounds ….

There will be people here who know the answer, I do not, does raise the question of what Medical Care Down Syndrome needs and how it is being provided now.

Well I assume the overstay is the only immigration violation as that is all the I 601a waives.
