thanks, for the link.it doesnt say that i need to send in her birth certificate,so i take it, it is not necessary for her to mail it to me?i dont need her birth certificate,just my mine?

Only the USC birth certificate is required (yours). Your fiancee will take her birth certificate (not copy) to the interveiw.

This link gives you all the information on what your fiance has to send you. Go through the checklist and compare it to the information, documents and everything else that you are including in the I-129f package.

jasman0717 what part of cebu is she your fiancee from?

did your fiance send in a copy of her birthcertificate or the original?what you mean the long one?is there a copy or sample of the birthcertificate that i could take a look at?

Actually Claudeth is from CDO, specifically Bayabas. We just visited Cebu several times, very nice city. We always stayed at the Holiday Plaza Hotel over by Robinsons. Cebu, Dumaguete and CDO are my 3 favorite places but I still have almost 7,000 islands to visit :P

I did sent a copy of Claudeth's birth certificate with the petition and she took the original and some copies to the intervew.

The long form birth certificate is the one that lists both parents. Some certificates only list the child. Take a look at this link: http://www.gov.ph/faqs/civilregistration.asp

Your attorney is doing her job - using her experience to minimize the possibility of issues that could cause delay in your case. The odds of an RFE for the beneficiary's birth certificate may be very low, but an attorney's job is to improve the odds not play them.

There is no firm requirement to include the beneficiary's birth certificate with an I-129f petition. But it is an item that case officer's send RFE's for often enough that it is prudent to include a photocopy in the petition package anyway. The CSC in particular has been known to send an RFE for the beneficiary's birth certificate.

Interestingly, my attorney asked me to include my fiancee's birth certificate with my I129f. When I questioned her and asked why and who and how it needed to be translated it resulted in her saying "We generally include it to precent a RFE". When I pushed further saying that it is not even required at this point in the process I was told "We have filed hundreds of these, it's best if you include it".

Well, I didnt provide it. And, as of yet, I haven't been RFE'd. Then again, I dont have my NOA2 yet either, so the jury is still out.

So as you can see from all the responses here, there isnt only 1 answer to your question. But in summary, keep in mind these points:

1. There is no hard requirement to submit the beneficiaries birth certificate, certified or simply copied, with the I-129F application.

2. Some percentage of people choose to submit the beneficiaries birth certificate with the application, even though it is not required. They do this in hopes that a more complete set of information *MAY* minimize any delay in the approval of the I129-f application. If you want to do this, a photocopy or scanned&printed image is perfectly acceptable to submit with the I-129F.

3. Regardless of what you choose to do when you submit the I-129F Application, the beneficiary will be REQUIRED to submit her official NSO AUTHENTICATED LIVE BIRTH CERTIFICATE issued and printed on NSO SECURITY PAPER at the time of her Interview at the US Embassy in Manila. This can not be a photocopy or any other form, but must be an official document issued by the Philippine National Statistics Office (NSO). This offically issued certificate is considered to be an 'original' copy for identification purposes.
