Hopefully after reading through the thread that your visa expired the moment you used it to enter the US, so while filling within 90 days is ideal, it's not usually a biggie if you don't (unless you get arrested for something else entirely and the authorities report you to ICE for unknown status).

Hopefully you have also joined your monthly AOS Filing Thread and done some research within it and also some research by using the search bar about K1 AOS filing, so you can educate yourself on the process as there is nothing for you to be worried about at the point other than a possible RFIE/RFE months from now which is hardly the end of the world.

Education calms the nerves. Learn the process and you'll have no reason to be so alarmed.

No. That is NOT required.

A K1 is excluded from redoing the medical and filing an I693 provided their DS3025 is marked complete. 

OP says they attached a copy of their DS3025. That is all they need to do until (or IF) they are advised anything further is needed. 

 

@wildbug100420ensure you have read the I693 instructions before making such a grand statement.

 

I693 is for those filing AOS from within the US who aren't K1s and who have not completed an immigration medical.

Huh? Opened what medical?

This is a K1 AOS filing. 

The OP submitted a photocopy of their DS3025 as recommended. 

The OP doesn't even have their sealed medical to be able TO submit it. That was collected at point of entry in the sealed envelope and has been shipped off to storage from DHS to USCIS with their A file. It won't get opened until the adjudicator gets to their case months down the line. 

 

Geesh. No need to freak out the OP more than necessary, guys.

Feb 26 we sent i-485, i-131, i-765 and g-1145 to Elgin lockbox.  Feb 28 it was delivered and received by Mendoza. Still didn't hear back anything. Check was not cashed. Yesterday i called USCIS, they say they don't have my application in the system.

I tried to google if person with name Mendoza works with USCIS and found that many people don't hear anything back if it received by Mendoza.

I checked address and it shows Chase bank building.

then i found that USCIS recommended not to use staple and i used staples for each form.

and i wanted to change my last name but in all forms i wrote my maiden name because i thought it needs to match my name in my passport

 

I am afraid that my package got lost and soon ill be out of status. Is there anything I can do?  If it didn't get lost and I send new package with changed last name can i cancel first?

 

 

 

your emotions are completely valid . Some times it can take 30-60 days before checks are clearly. as long as the mail package says its delivered it is delivered to uscis. Do not worry. 

 

as long as your package has the minimum documents and the cheque clears.. you are safe. not to worry

We sent to Pheonix. Took them 25 days to cash my check. It can take a while.

Thanks everyone for you responses its very helpful

 

I planed to prepare new packet over weekend and send it Tuesday if i wont hear anything back about first. Then if they get both packets keep checking which check they will cash first and put on stop second. Also not sure about it but prepared second packet makes me feel better.

Today i got sms Thank you for contacting USCIS. Please check your email for more information about your pending inquiry. I checked everywhere even spam and there was nothing. Before i even didnt know i have pending inquiry

I would either stay the course with the first package. Otherwise, you could end up with two paid I-485s in the system...and that would cause a problem.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We stopped payment and submitted new package on march 12th. It was supposed to be there yesterday 6pm but USPS still didnt deliver it. 

Today i got text message from USCIS that they received my case and gave receipt number, i checked and it was my first case...

You were advised to leave it alone and let it process...

 

Things are slow with USCIS. Simple things take weeks, months and even years to get processed. 

 

I hope you'll get the second one accepted in the next 4-6 weeks.

Why would you send a second one? Several people, including me, told you to wait. It still hasn't even been that long. You're making it so much harder than it needs to be. You can't handle US immigration like this, or you'll drive yourself mad. Every part of this journey is slooow.

I was sure that there is problem with my first package. I thought it got lost because i found that UPS put ZIP code 60124-7700 instead 60124-7836. Now i know that if last digits dont much but it was received by Mendoza it means they received it for sure. 

Then i read monthly AOS Filing Thread and found that w-2 and employment verification letter we didnt submit. When i called USCIS last time they advised to cansel payment.

USCIS info line is called the USCIS "misinformation line" for a reason.  Why would they tell someone to cancel payment on a petition which had been delivered only 2 weeks before?  Man, they mess up a lot.

I don't know whether it's lack of training or deliberate tactic to get people off the phone - a lot of USCIS tier 1 agents would tell you incorrect information.

 

I'd imagine if you give them any clue such as "should I cancel payment"?, they'd reply "yes". If you asked them whether you should leave the US, they'd advise you to.

 

My theory is they're underpaid, undertrained and have a goal of answering XX number of calls an hour. If they answer lower number they get penalized. I cannot explain otherwise why so many times their advise hurt VJ members.
