My wife (petitioner) called USCIS on --/--/07 about status of application. Today i received a letter from USCIS mentioning that your I 130 was approved last year on July --.If you did not receive approval letter you need to file I 824 and send $340 money order.

We did not receive any thing about approval before in mail or email notification and beneficiary (me ) waiting for FBI check.

what is I 824 ?

Why should i file $340 while on form it is said filing fee is $190?

--Jan 13,2006 Entered USA as Visitor (B2) ( I-94 is valid till end of June,2006)

--March 28,2006 Married in Naperville ,Illinois to United States Citizen

--April 5, 2006 Medical examination (I 693)+ Vaccination supplement form completed (chicago)

--April, 18,2006 AOS Package(I 130,I 485, I765)+supporting documents sent (chicago Lock Box)(DAY 1)

--May 1, 2006 BIOMETRIC APPOINTMENTS ( I 765 , I 485) received by mail for May 6, 2006

--May 6, 2006 BIOMETRICS TAKEN BY USCIS in Naperville (Day 19)

--July 21,2006 Initial Interview but waiting for FBI NAME CLEARANCE (Day 92)

--April 25, 2009 Infopass appointment to inquire my case : Result case was approved in June of 2008 but no body bothered to update my file (Day almost 610 )

--June 29 ,2009 10 year green card with date of Perm resident June 2008 received (Day almost 680 since interview )

--July 2011 Citizenship Interview :

-- Nov 2011 Oath Ceremony -US Citizen

Ans,

I-824 is, in your case, a request to get another copy of the I-130 Approval Notice.

The filing fee was increased effective July 31, the fee stated on the current form will be updated on the next edition.

The approval notice for I-130 won't do you any good, so I wouldn't waste the money on it personally, unless USCIS are asking you for it. The important thing is your I-485 approval, and if that isn't approved yet, then you're still playing the waiting game.

FYI: I never received an approval notice for my I-130, online or paper. However I did get my green card so I don't care.

I-824 is used to request a replacement approval notice. The Fee is 340 for them to process.

If for some reason you moved while they were processing the I-130 the approval notice may have been lost.

They assume you received it and then lost it.

15. Evidence of eligibility.

A. Based on an immigrant petition.

Attach a copy of the approval notice for an immigrant petition that makes a visa number immediately available to you, or submit a complete relative,special immigrant juvenile, or special immigrant military petition which, if approved, will make a visa number immediately available to you.

YuAndDan: They have already filed for AOS with I-130 concurrently and have been interviewed. They don't need the I-130 approval notice.

Spending money on I-824 would be a pointless waste of money.

Thnaks. I decided not to spend money on I 824 and get approval notice of I 130 if it would not help me. I am thinking to call USCIS and ask them about my FBI name check list.

i never got an approval letter too! just got an email stating that I485 was approved and my greencard.

So don't worry about the approval letter!

You do not need the I-130 approval.... I too filed I-130 along with AOS and like others I have never received the letter of approval.... but I too have my greencard....

I would go so far as suggesting that those who file I-485 and I-130 concurrently don't get a paper approval notice for I-130 as the norm. Anyone care to contradict this?

No contradicting that, makes sense, when filled together, the cases will be linked, and proof of I-130 approval would not be needed.

This is also indicated in the I-485 checklist in the I-130/I-485 guide.

Indeed. My "anyone care to contradict this?" comment was aimed at hopefully drawing in someone who filed concurrently and did get an I-130 NOA2 BTW. After all right now we only have my, Kez and maybe the OP's experience in the pool, not really enough to make a definitive statement that a concurrent filer does not get I-130 NOA2.

I fully intend to contradict this - filed them both concurrently, got the approval notice for I-130. I'd say, some people get it and some don't :)

I got it after the interview, along with the welcome notice. Same day, I think.
