I-134 Affidavit of Support for K-1 fiance visa London Embassy

My fiancée does not have a high income. She is on SSDI. However, she does have more than $100,000 in a family trust from an inheritance. Would this money count as an asset of hers for the purposes of the I-134 Affidavit of Support for K-1 visa? I am guessing not as the funds are not under her control. The trustees of this trust are two close family members.  Could this trust be a financial co-sponsor or do co-sponsors have be natural persons?

Second question, has anyone sponsored himself/herself on the I-134 at the London Embassy? When my house is sold I will have about $100,000 in cash after the outstanding mortgage balance is paid.

(I am also trying to find a financial co-sponsor.)

I self sponsored.

What is your plan for the I 864?

That would be my guess as those assets are not liquid and available to the beneficiary of the trust.

USC should be here to ask the questions

Because the assets of a trust are no longer the property of the trustor,  a creditor can not not come after them to satisfy debts of the trustor

trust are created to protect the money from either inhertance taxes ,  probate or creditors (in this case USCIS)

Does she get a monthly,  quarterly or annual check from the trust which can be counted as income?

Thanks for replying so quickly.

I am wondering how I could self-sponsor.  Would a valuation from an estate agent (realtor) be sufficient? I have an email giving me a valuation. I could also get details of the outstanding mortgage and ownership deeds. My fiancée's SSDI income is around 100% of federal poverty guidelines. I need to get the precise figure.

In terms of the I-864 I don't think self-sponsorship would work. As a household of two adults and one child we would need $32,275 x three = $96,825. A modest wedding, I-864 filing fees and a month of living expenses would take me below that figure.  The person who agreed to be my financial co-sponsor is busy with family issues so I don't want to disturb her too much. She should be more available in the Summer or Fall when I arrive and need to file the I-864.

Thanks for taking the trouble to reply.

No, there is no regular income from the trust. How it is distributed is at the sole discretion of the two trustees. The family member who set up the trust believed, incorrectly in our opinion, that receipt of an inheritance would make my fiancée ineligible for SSDI.

A Bank statement would be fine showing the proceeds of the sale.

I would have the Joint Sponsor lined up for the I 864

Thanks for your interest in my problem. That was my thoughts as well. The beneficiary of a trust has no control over its assets.

The sale would be three or four months after the K-1 visa.

I will see if I can get the joint sponsor sorted out for I-134.

Do you realise you only have 6 months from the date of the medical to move?

It does seem like you are looking to cram in a lot to a very short period.

Medical should be done before the interview
