I-131 Rejection Notice

Hi,

I received a rejection notice for a I-131 we filed. Lots of things don't make sense, can someone shed some light? I have already made an Infopass appointment since I called the USCIS hotline and they were less than useless. We filled out this application on July 20, a full 10 days before the fee increase and the NOA shows that they received it on 7/22 with a notice date of 8/1.

Here are the 'reasons' for the rejection:

1. "The application was filed with an outdated version of the form."

I downloaded the form a few days before July 20. The date on the form is 05/02/07 and the form ITSELF states that the expiration date is 11/30/07

2. "The check amount is incorrect or has not been provided"

They sent us the $170 money order back.

3. "A Valid signature is not contained in the signature block of the application or petition"

There's only one place where you're supposed to sign, and we did. This is in Part 8. My fiancee filled out the application herself, so there's no need to sign Part 9.

4. "The application has not been fully completed. Please answer all questions fully and accurately."

It goes on to state that the following fields were not completed:

"COUNTRY" -- But it doesn't say WHERE I missed it. Part 1 has 3 sections for country, and they're all filled out.

FAMILY (LAST) NAME" -- No clue where this is either. Part 1, #5 is filled out. Part 2 I check letter 'd', so there's nothing else to do. I skipped to Part 7 and don't see any other sections where this information is asked for.

"PART 2 APPLICATION TYPE" PLEASE CHECK 1 BOX -- As I stated above, I checked option 'd'

"STREET ADDRESS" -- Part 1, #6 is filled out. Part 7, #3 does not apply since the document will not be delivered to an overseas office.

Can someone tell me what went wrong because I am simply stunned and numbed at the reasons given us.

You are filing an I-131 for your fiancee?

Sorry, for my wife. We already went through the I-129 and got married with the 90 days. The I-94 expired on 7/27 and we filled out the 485 and all the other forms on 7/20.

Geez....have you thought that maybe no one else has experienced this? Yeah, you'll just have to wait and see why. Then you can come back and be the resident expert on this type denial. :blink:

No one is an expert here at VJ, we are all amateurs and untrained in immigration law.

Your situation does indeed sound like USCIS error. If I had received this rejection I would be visiting an immigration attorney for advice on how to point out the errors without offending the person(s) who might read the explanation.

EAD card ordered again (who knows, maybe we got the two-fer deal): 10/23/-7

You guys are right, of course. No one here is an expert and I shouldn't assume as much. I made an Infopass appointment for this Thursday and hopefully I will get this straightened out. And yes, I guess the other petitions were accepted since I didn't receive any letters about them yet.

I will let everyone here know how it goes.

Here's what happened. I went to the Infopass appointment and explained my problem to the window clerk. He looked over the documents and said, "well yeah, you missed this and that and the other thing." I calmly explained to him that I didn't miss anything, proved it to him by showing where the document said I missed something and pointing where it was filled out. That wasn't good enough for the guy. He insisted that I used the wrong form for the AP, that I should've used the one dated 7/30/07. I explained to him that I filled out and mailed the form before 7/30 (and that older forms were ok to use as per USCIS), the guy insisted that I used the wrong form!

I finally after much wrangling got someone else to 'help' me, but this person also insisted that I used the wrong form. I showed them on the I-797C NOA where it stated the date that they received it, 7/22 ... they still thought I used the wrong form. They insisted that I should've used the new form and that I had to download it from the USCIS websitre. I told them that on the day I filled out the forms (7/20) they only had one form; the one dated 05/02/07 and that there was no way I could download the newer form. I also told them that the new form doesn't have to be used until 7/30. They still insisted that I used the wrong form.

By this time I was getting pissed of. They got two other women to look at the form and 'explain' to me that I used the outdated form. When I tried to explain to them the issue they actually WALKED AWAY from me before I was finished (I was the last customer of the day, by the way.) By this time my voice was raised as I asked for a supervisor. First thing supervisor says is that he'd appreciated it if I didn't raise my voice. I told him I'd appreciate it if someone would actually listen to me. These people obviously didn't know anything about their job.

I explained to the supervisor the same issue and he looked at the reasons for the rejection notice and at first agreed with his people that I used the wrong form. After explaining to someone that I used the right form for the umpteeth time and pointing to them that I did the supervisor finally agreed that I did nothing wrong and that the reasons for the rejection didn't make any sense.

The supervisor said that he would see what he could do and asked me to take a seat. 10 minutes later he said that he spoke with the office in Chicago and that I would have to resend the application again and that's that.

The office in San Francisco is full of idiots. Out of 7 people I have seen only one has been helpful so far. I hate to sound harsh but when you try to explain the same thing over and over and they insist that you did something wrong, and then you prove to them why you think you didn't do anything wrong you would think that they would put 2 and 2 together and see that you're not mistaken. It finally took the 7th person to see that I wasn't mistaken. Now because of USCIS stupidity I have to resend this application. I am thinking now of not sending it again and just waiting for the Green Card.

I don't know if this applies to you or not, but if something on one of the forms does not apply to you ie. there might be a box for an apartment # and you don't live in an apartment, make sure you write NONE or N/A in all boxes that do not apply. For some reason, they do not seem to like blank boxes. Something as simple as that could make them say that the form is not correctly completed.

Hope you get it sorted out. Sorry you had a bad experience with your local office, ours has been great.

AOS TIMELINE

16th December 2005 - Sent I-130, AOS, EAD & AP USPS overnight to Chicago Lockbox

18th December 2005 - Received at Chicago 9.18pm.

23rd December 2005 - NOAs for I-130, AOS, EAD, AP!! Didn't expect them that quickly

13th January 2006 - RFE for Medical and additional I-864 info

17th January 2006 - INFOPASS Apt about RFE.

23rd January 2006 - Appointment notice for Biometrics on 10th Feb.

10th February 2006 - Biometrics Appointment

21st February 2006 - Medical. Cost $250 including all blood tests, Td Shot, TB test and Titers for MMR and Varicella.

27th February 2006 - Appointment with immigration lawyer re. RFE for I-864.

1st March 2006 - Final results Medical. Papers in hand to send.

10th March 2006 - RFE responses to Lees Summit

13th March 2006 - RFE responses signed for at Lees Summit

24th March 2006 - Emergency AP approved in Omaha

28th March 2006- Collected AP

31st March 2006 - EAD Approval online

7th April 2006 - EAD arrived in mailbox.

21st April 2006- Received Interview Date for 22nd June

9th May 2006- Received SSN

22nd June 2006- AOS INTERVIEW APPROVED

REMOVING CONDITIONS

June 20 2008 - Package mailed to CSC under new rules. Would have been an NSC transfer

June 23 2008 - Package recieved at CSC

June 27 2008 - Recieve NOA1

July 16 2008 - Biometrics

July 17 2008 - Touched

September 9 2008 - Card production ordered
