L-1 APPROVED BY USCIS, REFUSED UNDER 221G FOR MORE THAN 180 DAYS. (Merged threads)

Hi guys,

Stuck under 221G for about 6 months now. Case last updated changed 2 times in 15 days. Cannot reach out to US consulate in Dubai to ask for any update. Submitted documents that they asked after which the case last updated date changed twice. Had got yellow slip if that is helpful. Let me know if someone went through something similiar! Any help is appreciated.

Timeline

The best person to speak to would be the Company Lawyer, they will know the full details of your case and what could be the issue.

As said in your other thread, AP can take weeks, months or years. You could file a WOM to force them to make a decision but if it’s only been 6 months I’d say it’s too early for that. 
 

What documents did they ask for? That might give an indication of what their concern is and what the extra checks are for.

This is a non immigrant visa, they have the discretion to issue one.

My lawyer said that they cannot do anything as he got my L-1 approval from USCIS. Now it is in the hands of Us consulate in Dubai, only thing he can do is file a case agaisnt them which is a little too much right now. All I am looking for is if anyone knows an actual point of contact and if someone has gone through this in Dubai or anywhere else and what did they do!

Still not seeing the USCIS connection, maybe ask the US operation to contact their Congressperson amd make an enquiry?

That sounds to me like they have suspicions you want to use a non-immigrant visa to stay permanently or that the role isn't genuine. Hopefully whatever you supplied them with will overcome any doubts they have and all you can do is wait it out - I think too early for a WOM but that's an option if it goes on much longer, you could discuss with your company and see if they are prepared to pay for it to get you out there sooner.
