is sharia divorce accepted in USEM

Hello, is anyone here same case as mine? is sharia divorce accepted in USEM by this year 2024. I was married before in catholic church. me and my ex convert to islam and file a sharia divorce. now my cenomar with a remarks of....ANNOTATION WITH SHARIA DECREE DIVORCE. my question is this valid and acceptable during interview? should I not worry about this?

This thread includes some good reference material.  From what I can glean, if you were married under Sharia, and both Muslim, then a Sharia divorce should be acceptable.  Based on your story, it may not be.

Annulment Decree and Declaration of Nullity
 
Available

Fees: Dependent on the issuing court

Document Name:  Annulment Decree

Issuing Authority: The Family Court of the province or city where the petitioner or the other spouse (called the “respondent”) resides for the last 6 months prior to the date of filing, or in the case of a non-resident respondent, where he/she may be found in the Philippines.

Certified Copies Available: Certified copies of the Annulment Decree or Declaration of Nullity can be obtained from the appropriate court.

Registration Criteria: The Annulment Decree or Declaration of Nullity must be registered in the Civil Registry where the marriage was registered, the Civil Registry of the place where the court is situated, and in the Philippine Statistics Authority.

Comments: Note that a petition for “annulment” refers to voidable marriages, which are valid until annulled by the court, while a petition for “declaration of nullity” refers to marriages that are considered void or nonexistent from the very beginning.

when u and husband both converted to Islam , your catholic marriage was valid but u can not divorce under Sharia laws as u did not marry under them. 

u need to annual under Catholic church rules as they do not accept divorce 

You are still considered married to  former husband

You are still considered married to  former husband

Nonsense, according to the MPL, Article 178, wherein it states,  Effect of conversion to Islam on marriage. The conversion of non-Muslim spouses to Islam shall have the legal effect of ratifying their marriage as if the same had been performed in accordance with the provisions of this Code or Muslim law, provided that there is no legal impediment to the marriage under Muslim law."

I think basically there was a period where there was widespread abuse of the practice of converting to Islam solely to avail a Sharia divorce in the Philippines.  It is more of a political issue rather than a religious issue.

 

Rapid Visa put up a really good article on the issue non-Muslims converting to Islam and getting a Sharia divorce in the Philippines.

Before Duterte this was a very common thing to do for many Christian people trying to get a divorce that were married in the Philippines. They would " convert to Islam" get a divorce under Sharia law, and then be good to go so that they can be petitioned by a fiance or get married in the Philippines again. But during duterte's presidency he asked the embassy to deny people that did that, so since then the US embassy has been denying people that have done this. So it is not a valid way to get a divorce in the Philippines anymore if you aim to be petitioned by a fiance or future spouse.

When did this happen? Before Duterte called Obama a son of #######? Or after?

  Cyberfx1024, is this in fact true ? Where is your proof that Duterte did this ? If true, Duterte was and is nothing but an enemy to his people.

Of course it's true. That's why Sharia law divorce is not a practical means of divorce if you were married as a Christian. They will reject it

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
