A lot of this depends on the Consulate, you mention ESTA so I doubt you have too much to worry about.

 

I think my letter was one sentence. None was interested in looking at more that a photo of both of us.

She visited 4 times in the past 2 years and we also had two vacations. So that would already be quite a lot documentation I feel like, maybe too much?

 

Title Page proof of evidence:

In the K1 Guide it says to include a single page that has a brief description of the last meeting (same text as in Form I129f) and a list with all the evidence provided. On the  website of a law firm it says to include a declaration letter that goes more into a detailed description of the relationship, the sample there is about 1 page long.
 

 Does someone have an opinion on that ? 

 

Documents to include

- I-95 travel record: Is just this one page that you can download, or is there more to it ?

 

- My last attempt to enter the U.S. was refused (ESTA), hence my I-95 says “UNKNOWN” for “Stay permitted until”. Should I put this in the box on the I129f?

 

-Should I include my passport (beneficiary)? So far we included the front page and my US visa page with the stamps

-Should I include sth like a transcript from the school I went to as an exchange student in the US?

 

If someone takes the time to reply to this, I would be really happy :))

Only include what is asked on the 129f form. Beneficiary passport not required. It only asks for last visit to USA and if applicable the details of entry if currently in USA. Text messages are weak evidence

Makes sense. I just don’t know if I should include my last actual visit where I stayed for a semester aboard in 2021, or where I was refused admission at POE while traveling with ESTA. I should go with the most recent entry on the I-95 probably, which would be the refused admission one?

What happened when you attempted to enter the U.S.? Were you allowed to withdraw your application or did you have to go through a different process? 
ETA You only fill out the details of last entry if you are CURRENTLY in the U.S. 

As you are outside the US ignore this section.

If you’re referring to the section in I-129f where it’s asking you for the I-94 stuff, if you’re not currently in the US, you do not fill out that section.

It was a refused admission, no removal or anything. 
you sure I can ignore the whole section? I saw a YouTube video guiding through the I129 says to fill out regardless.. 

So I leave it completely blank and don’t even put the I-94 record number or my passport number ?

May I add, go slow and double check your entries for errors or typos. Example in your post you repeatedly refer to I-94 as I-95

Will likely be denied. But, no harm in applying if money is not an issue.

The difference is give or take $2500, that's how more expensive K-1 is compared to spousal visa.

 

Plus with K-1 she'd be stuck in the US for 6-12 months not able to work or travel. Some EADs come fast, while others take 9 months or so.

 

Essentially, if she enters as a spouse, you'd pay fewer fees and she'd be able to start working within few weeks of entering. Even if it's a small part time job, it can make a big difference. Plus, when entering on spousal visa she can travel internationally next day if she desires, while with K-1 she may get stuck for 6-18 months until GC or advance parole shows up.

$1440 is just I-485 fee. I never wish anybody waiting for GC without AP and EAD, that's rough considering processing times.
