Questions about dependancy requirement on the Minimum threshhold.

I have to pay child support for a child i havent seen since they are 1, its been 10 years. i was never married to the mother. and the child is not biologically mine. Would this count as a dependant of mine on the visa consideration for minimum income threshold.

I unfortunately dont yet make the 125% required for adjustment of status however i sit between and meet the 100% required for the K1. 

Do you know how long the beneficiary has before they have to start filing for AOS?

You are best to file for AOS by the 90th day. Do you have to? No, but your fiance will be out of status and can be detained/removed. 

 

Have you already filed for the K1? 

If not you may want to explore your options. With the fee increase it is going to be disgustingly crazy to pay those fees.

Did you not do any research into the details of the K-1 before choosing to do one?

I appreciate the help on the info. And yes we have looked into it. We kinda were having an emotional panic type situation but weve worked it out and figured out what we will be doing. I apologise for the inconvienence.

I strongly recommend a qualified joint sponsor if you want things to go smoothly.  Or get a second job to increase your income.
