Did any multiple filers actually get approved?

So I filed for my first ever k1 in 2020, she arrived to usa in dec 2021. we got married 2 months later, she got her GC around june 2022, we got divorced in dec 2022. so the marriage almost lasted 1 year. she is still here in usa finishing her medical degree and going about her life. I have not read of another multiple filer whose ex is still in the usa and their new k1 got approved.

 

I applied for my second k1 in feb 2023, and we are close to interview and im just wondering how much scrutiny will we face due to the previous k1 and divorce? and if any special paperwork or evidence we should prepare for.

 

Furthermore I want to know if something similar happened to someone and if their second k1 got approved?

OP already has NOA2, so I think his concerns are more about the interview.  Timeline says India, but I know nothing about India interviews.

No waiver was needed in my case because my first k1 FILING DATE was more than 2 years from my second k1 FILING DATE. 

 

Yes J.M., I suppose interview is my main concern right now with my history where my ex is still in the country (legally). Most other multiple filers posted where they withdrew the case or their fiance or ex wife left the country. Mine has stayed, and decided to work and transfer her medical degree to the US. This was her decision and she is on her own right now as we have been legally divorced since before I filed my second k1.

 

Since my fiance country is considered in the top 10 of USCIS watch list, I'm guessing that's for high fraud rates. Philippines is also on the top 10 list, so even if someone from that country can chime in, it would help. I know the process since I have done this before, we are currently collecting paperwork needed at interview. I finally found someone I was looking for, and don't want to make any mistakes so trying to prepare well so we can be together soon.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My ex is from the Philippines, here through K1 process.  We were married for 5 years, then divorced.  I applied for a 2nd K1 approximately one year after divorce.  It was approved and her visa is already in hand.  My ex is still in the US.  She is a US citizen now.  That was one of my conditions for divorce, so the I-864 would be nullified.  I don't think my previous marriage was even discussed at the interview, other than to be sure she knew it existed.

 

Other than your continued obligation for potential support, through the I-864, your ex has nothing to do with you or your petition.  She is on her own, like any other ex.  Since you already have NOA2, you have already met the requirements for YOU.  All that is left is for your fiancée to meet HER requirements.  I doubt the consulate will do much more than advise her that you have done K-1 before that didn't work out and question her a little more vigorously about your relationship.  They are not match-makers.  Their sole job is to look for fraud or legal reasons for denial.  Have your fiancée take plenty of evidence of your relationship.  Make sure she is well informed about your divorce, why it happened, and very comfortable discussing it during the interview.

 

I am hesitant to compare the interview process for the Philippines to India.  I have no idea what is asked in India.

 

You are not the first to get a second K-1, but your divorce date vs your filing date is really close together, so that is why she might get extra questioning about it.  Prepare her for that and you should be fine.

You're cutting it close with your short marriage, quick divorce and quick refile for a new K-1.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Thanks, Good to hear another second k1 like me approved. I have already proof of video calls, chat logs, chats discussing marriage idea and invitation card, affidavits from her brothers and sisters who witnessed our relationship, many photos of my family and I, meeting her family, shopping together, rings we exchanged and receipts. We are talking daily, practicing some questions they might ask, and I told her everything about the ex and what happened. India, from my last experience and some friends, the interview is pretty relaxed as long as you have all the proof and documents, so might be very similar to Philippines. 

 

Yes it was a short marriage, and quick refile. What to do, it was covid time, things just didn't work out for us and we had changed over time. We tried our best and eventually filed for divorce. I'm not getting any younger and want to start a family soon.

Be sure to start a family with the right person or you will have more troubles later. Do not rush. I should know as I learned the hard way. I have had more than THREE K-1's approved. You will be fine.

Thank you, I sure will this time. This is the beauty of the k1 visa, it gives us a little more time. Was all your k1s from the same country? any extra scrutiny during interview that you remember?

Philippines. Interview for her was not fun. She is the one who needed to get approved.How did your interview go? Is she here now?

Thank you guys. My interview went fine. Luck for us, the lady behind the counter was kind hearted. Most questions or documents we thought would be asked were not. Even the original divorce decree was not asked. Questions about my previous k1 and why we divorced were not even mentioned, just the date of divorce was asked and if I filed for divorce after meeting her. Other than this, it was just like a normal k1 visa interview. One thing I think helped us enormously is the fact that I visited her during the interview and was there 1 week before. They asked to see pictures of this visit and my fiancé said they confirmed a few times if I truly am here. Thanks guys for the help. Hopefully this helps the next person going through a situation like mine.
