The Officer at 1st N-400 interview took the lazy way out. He could have initiated Service action to correct/update system. …or at the very least tell you to file fee waived I-90.

Your instinct is right, so go ahead and file for correction now to avoid N-400 delays.

They said that I could either keep the GC as is and not file for the I90, or I could file for the I90 and get the fee waived if I wanted. Ultimately, I asked will this impact any future applications and she told me no.

At that point I knew that the processing times were 16-19 months for the I90 and by then I would eligible to file the N400. Additionally, people told me that even after their I90 was filed their new green card still had an incorrect resident since date. So with that being said, back then I didn't file the I90.

Would it look bad on me if I file the I90 after already submitting the N400? I was worried the interviewer will ask why I waited so long to file it if I knew the date was incorrect since back in 2022, and that it will cause further problems at the interview

It will not look bad , no matter how you proceed. The practical advice when doing I-90 for correction is to hold on to the physical card until they get around to processing it and expect an RFE. …that way one goes on with life while also having the receipt notice in hand.

Gotcha, thank you for the response. A friend of mine who is an immigration lawyer suggested that I call USCIS and ask them to file a service request for an amended date. Not sure if I can do this. Probably filing the I90 is the best route.

Service request won't cut it. The procedure is to file I-90. I'm surprised this advice is coming from an immigration lawyer.

I think at this point I will show up to the interview with the GC with the incorrect resident since date, I can't possibly see that being an issue or a grounds for a denial... fingers crossed

Your friend has a wicked sense of humor ….or is a bit green. Feel free to set him straight 😂

You will not be denied…taking the requisite action will save you from potential delays.

Thanks, in that case I'll have a look at the I90. When I was denied the first time around I filed back in 2022, the IO actually said that in my USCIS file my resident since date was there, she wrote it down on a sticky note and gave it to me.

If you were in my shoes would you file the I90 and then ignore the RFE? Will the I90 possibly delay my N400, or not related?

The I-90 to correct will not impact the N-400 ..and I repeat, keep the card til RFE
