anyone one have ideas for me ?

Awww man Shon! You have been going through this about as long as I have. It is a little different from ours, but hard nonetheless. So now remind us, what is the status of your case? Last I read they have issued more security checks right?

we had security checks compleated no objections on Jan 13th. I called DOS agian. they said

on Jan 18th security checks compleated no objections again on Jan 18th. - I thought ok this is good.

I find out another security check ordered on April 6th. dayum dayum dayum.. what possesed me to call

DOS was the fact the embassy said. " we need one more week then your husband will get a response

from Amex - courier " I thought how weird is that. so I called DOS like a big fat BOOM on my head.

" security check " :( I told the lady ok.

Dayum Shon....by the time they are finished with security checks on you and your husband they will have to create new ones. We could call one the "Lets see how long we keep Javed here" check, and another one "lets see how far we can push Shon" check. Okay okay...its late and I am losing it today.

Seriously though they can't hold out much longer. How long have they had your application? What is the normal turnaround time in your consulate? I think they are just finishing up whats left before your interview. Just hang in there, they are just dragging it out because they think they can get you to give up. You will win and you will have your sweet Javed here soon Incha Allah

the application for K-3 has been in ISL since May 2005 and CR1 since Dec 2005.

one of the people on ISL forum said that its possible that they are done. so they had to do one final security check. then issue the visa. once you interview they dont make you interview twice. they just issue the visa.

she said it took 2 weeks for them to do her last security check- then they called her husband to come get the visa. I pray I have the same luck.

One interview? The one for the K-3 is still valid? I don't know how it works in your husbands country, but the police report in Morocco is only valid for 3 months, so my guess is that they would want a new police record. Also, with 2005 taxes coming due, I would assume that they will want those returns as well. I am planning to take another trip to see my husband in August, so I am going to take him additional backup, including the 2005 taxes. With our luck if he didn't have it they would want it. Now I am just assuming he will get a second interview, but if they just issued the visa then that would be cool!

Now wait a minute, Chiquita's husband has already had an interview for the K-3, and I am assuming they are giving him another interview for the IR1. But if what you said is true then he won't have to go through it either. How do you know for sure?

my husband turned in a new police report about 3 weeks ago. as they requested. my husband also turned in tax 2005. with packet 3.5 < mar 15th >.

everyone that interview at ISL for k-3 and when the CR1 or IR1 gets to the embassy. they process it send packet 3.5 and then wait 3 weeks. they call you to come get the visa. they dont give you any set time or date they call you. or have you go to the courier and recive it. we all were given tokens to pick up the passport. but, for some reason they did a security check. they ordered one. - my guess something proble expired.

I am really praying for you Shon, you have been one of my highlights here on this board. You have attitude with style, without compromising your compassion. I admire that. You are always upbeat and willing to help others stay upbeat. I know the hurdles you have had to overcome with this whole immigration situation, and I admire how you have stayed strong to the cause. You can go on the following government site and read more about the sec 212:

http://travel.state.gov/visa/frvi/ineligib...ities_1364.html

I have read that section over and over, no where did I see where it said what you said>>>

2) If I remember right you have a at least a 12+ year age difference. Anything over 10 years is a red flag based on Sec. 212 reasons a CO can use to deny.

Please show exactly where it is because I cannot find it.

Lets just be clear on one thing here. Most of the returns are "due to the validity of the relationship". If one has not yet received that information from your congressman or senator, you will.

As I posted earlier the consulate is not doing their job. Period. Thay complain they do not have enough time to take phone calls. They dont answer e mails. They are sending a message...they want more help. Mc Keever told Leila to tell her congressamn they need more help. This is a political issue and we are the pawns.

I had a conversation with another woman who was denied a visa also and she brought this to light from something she had read on line and when she read what McKeever said to Leila. It became so clear that the consulate is doing this in hopes of getting more help.

As we all know there are cut backs in every industry and occupation across our country. I am sure it is happening in the government ranks as well. But what Casa is doing is just plain wrong and thats my opinion and I'm sticking with it.

If anyone is interested how my case turns out, just e mail me and I will be more than happy to tell you. It will soon be over for us. I want to help as many other couples as I can who are lost in this black hole called immigration.

Chow

To tell you the truth, sometimes I feel the American Embassy at Casa have not idea what they are doing reference to the K3 petition. How come they denied many K3 petitions and returned them back to USCIS often? I feel they dont know how to process these but then again they are suppose to be current to all information regarding to Immigration process. Also, I think they hand out the "validity of relationship" as just a standard way to tell you really nothing. We all know this. They are making judgement calls but based on what we absolutely do not really know. Maybe it's recorded to our files back to USCIS or not, only Immigration can tell us that or we may not even know. Of it's recorded to our files there at Casa but again who knows. I know as much as info we can get to help us is better than nothing at all. I dont think big age difference should be factor for "red flag", then again who the heck knows? I havent seen that on the website either under section 212 and I have read that many times. Where exactly is it? I like to read that myself as well.

Thank you. I have been praying so hard. this lady just told me that it took 2 weeks for her last security check. then the embassy called her husband to get his visa. I am gonna assume 2-4 weeks.

I pray everyone on this board is reunited. I am sick and tired of hearing about all the illegals getting a fast track for anything. this stuff is too hard :( the hard part about this is when you or your sweetie crys and you cant dry their tears. or when they are sick and we all know how stubborn men are. we cant even be there to offer them some delicous Nyquil. lol how sweet the days will be when we finally are reunited- right.

I think it was honey or chi. maybe both pointed out Casa has a problem they are doing something wrong. everytime I think about the returned the petiton thing. I thought the embassy offical had to allow you to prove your case- I thought the burdon relied on you. this seems not to be happening. they wont see your proofs. maybe its the time factor they are rushing. to the point they dont give you a chance to speak this is not good :( I dont know just guessing.

Here's the online instructions for preparing a package for submittal to immigration:

http://uscis.gov/graphics/fieldoffices/scn...nal/index.htm#H

From the above:

"If you believe your situation to be unique, explain it fully in an attachment to the packet, not as a cover letter."

Also, for anyone filing AOS after April first this year - there have been changes so go to the USCIS webwsite and get your information there. I'm not sure how often VJ updates their info.

I got an e-mail from an internet friend that brought over her husband from Amman. His brother has a friend that went to the consulate for his interview about a month ago (in Amman). They are doubting the validity of the relationship and gave him the 221(g). Now here is the kicker....they are giving him an opportunity at the consulate to bring in more documentation to prove the validity! Now how is that for ya??? I don't know if they have a valid relationship, I don't even know the person, but I trust this friend completely that she is being honest with me. This consulate, although much larger and slower than Casablanca, is actually following the correct procedure.

This is what we are saying here, if you doubt our relationship, great, you are doing your job well. If you send it back without an opportunity to prove our case then you are violating your own procedures. Anyone can aruge it all they want, those of us in these shoes know the facts.

we had a case at islambad the couple were able to present the proofs.

Shon I have been mia due to working (12 hour shitfs x 3 days in a row + the flu :( ).

I just don't have any ideas for you. I wish I did. I don't know all about your case, but is your senator and congressman involved? If so, have they shed any light on the situation?

I honestly wondering if what is going on in Casa is also going on at other consulates, but in a different manner.

For instance, one of the ladies who had their case returned has been on line researching and researching, just as I am sure most of us have done. She discovered something rather interesting that rang a bell when she read what McKeever told Leila...ie "I don't get paid to talk on the phone, tell your representatives we need help". (Or something to that effect.) I was told last year..."I don't have time to talk on the phone, send an e-mail".

She remembered reading on a congressal meeting of the House of Representatives, Subcommittee on Immigration and Claims, Committee on the Judiciary in Washington, DC.

Mc Keever was there. This meeting was on visa fraud. Here is an excerpt of what McKeever said:

Mr. MCKEEVER: Yes, sir, I certainly agree with the rest of the panel, that biometrics are the wave of the future, but I would also submit that resources are also an important part of this, human resources. After you get by the biometrics and the computer, somebody has to go out in the field and investigate, somebody has to be in the consulates and adjudicate visa applications. And I think we need to keep that in mind to make sure that we have enough people out there, both fraud coordinators and investigators

Bingo...he is saying there is a need for more help to investigate the suspicious applications at the consulates. I am thinking that since it hasn't happened, the conoffs in Casa are just simple returning the petitons that are not cut and dried. This is their way of dealing with their staff shortage.

Perhaps the conoffs in other consulates are treating this staff shortage in others ways?

In other words your case may not have gotten the attention due to short staffing? And the conoffs are dealing with this situation in various ways to try and get their point across to our representatives? What better way than to use us to get what they need?

How many of us have pushed our reps to provide the funding needed for the DOS and DHS to be able to do their jobs? I could go on and on speculating, but that is not what any of us want to hear. But things seem to be adding up as everyone keeps researching this subject of returns and delays.

As much as I dislike the situation, whos to say that this is not happening? All we can do is write to our reps and tell them what is going on and ask them to tell us WHY and ask them to get it fixed.

I am sure we have all heard that if a govermenatal agency does not spend it allotted funds given to them in the year, they will be cut the following year. This is wrong but hey, what can we do but try to get the message across to our reps.

I am sure many times when those who are in the immigration process get their beloved here they move on and all is forgotten until we need DHS to do something else for us.

Just my point of view, I am not wanting to be political, but it appears this is a very political situation we find ourselves in.

For you Shon, I hope you get this resolved quickly. I hope everyone gets their beloved here quickly!!!!

Barbara, I hate to say it but I think you've hit the nail on the head. Money talks and the consulates want some so they're trying to get people to talk.

Personally I think they're going about it the wrong way, but then, what other options do they have? It's not like there are lobbyists for the consulates. Other interest groups just hire lobbyists, but how would the consulates do that? So they drum up support the only way they know how.

I was also in this situation. Montreal gave us the 221(g) for further evidence *AND* AR. We presented further documentation, and the CO was satisfied. Our case continued on AR after that for a few months. I believe this is the proper way to do it. The form actually stated you have a year to respond (unlike what the crazy people at Casa told poor Kader).

They must have some kind of agenda going on, this is quite a turn of events for this consul. I remember when I was applying and up until not too long ago, Casa was approving left & right. Its obvious something has changed, and Im sorry for all of those who got stuck in the mix.
