Filing Tax Married File Jointly with K1 Visa

I entered the country with a K1 visa in December 2023 and received a marriage registration and SSN.

It is said that the spouse will file a tax return in 2023 as MFJ this year (2024).

In 2023, there will be no income at all in my country.

There is interest on deposits, stocks, dividends, rent, and insurance.

 

1. I only have a K1 visa and am currently applying for AOS. Not yet green card.

2. Do I need to do FBAR and FATCA?

3. Is FATCA $50,000 including full account insurance? If MFJ?

4. Do I have to do it by April 15th this year?

5. Or if not, can I do it starting next year?

So you arrived in December of 2023, but didn’t marry until 2024, correct?  If you did not marry during the calendar year of 2023, you CANNOT file MFJ.  Your spouse needs to file 2023 taxes as a single person.

I arrived in the United States in December 2023 and registered my marriage in December 2023.

What does "registered" your marriage mean?

Marriage license is not the same as legally married.   If you didn’t get legally married in 2023, you can’t file as married for that tax year.

Oh. I apologize for confusing you. Correct. I am officially married.

 

Do I have to file a tax return for 2023 at the same time as FBAR?

 

Do I have to report bank interest, stock dividends, etc. from countries other than the United States?

 

Even though I am on a K1 visa?
