Hi,

 

Last Friday I received a denial letter from the USCIS on my I751 application. Notice to appear not arrived but in the letter says that I can defend my self in removal proceedings.

 

If I would refile before I got a notice to appear, how soon will I be able to travel outside of the US and what would I need for it? Advance Parole or Stamp? I still have the a travel stamp valid till Jan 2025 from the denied case. Will the refiled I751 attached to the previous one so my stamp is valid? Or do I have to get another stamp and how long does that usually take?

 

Also can I apply for a E1/E2 or B1/B2 visa if my refile got denied as well?

Do you know or suspect the reason(s) for the I-751 denial?  Refiling a new I-751 will likely be denied also unless you fix the problems with the first one.  Same goes for NTA.  An immigration judge will look at all the evidence, so either way you need to be very thorough.  If you get an NTA and go to court, an experienced attorney is strongly recommended.

This is the way to get an ADIT stamp.

First of all I really appreciate the will to help! Here more details

 

After I filed for I751 in 2019, I received an RFE. I submitted them and then a long period of waiting has started. During COVID we got apart we filed for divorce. My attorney filed a waiver. Then I received an interview and I went to the interview with my attorney 2 months ago. The interview went great, but I am shocked with the denial letter from last Friday, but no NTA in it. The reason is that they think it's not bona fide marriage. I know that I can defend myself on the immigration court but I need to travel in the meanwhile due to my health condition. I got a spine surgery 2 years ago in Turkey and also have a blood cloth in my leg. For these reasons I have to a few times in a year to Turkey to see my doctors and I will need another surgery by latest November this year. I also have a setup business back in Europe which I need to manage

 

- I am traveling since 3 years with a passport stamp and was waiting for my 10 years. I think now my current stamp expiring Jan 2025  is invalid unless I refile for I751? Or will I need to obtain a new stamp or advance parole or an emergency travel document because I need a surgery. 

- It doesn't bother me not to be able to live in the US anymore but I still have my ongoing business and my life here. As long as I can re enter the country even with a tourist visa I would be fine.

- I honestly think that the immigration court won't approve me because I don't have more evidence then I have submitted. And I don't want to be deported. Rather than that I would leave the country before I get a deportation in my records. 

- I will setup my new life back in Europe, but I would need maybe a year or two to make the transition, shutting down the US part of my business step by step. It all takes time and I will need to go back and forth to Europe to do all these. I am also ready to obtain a E1/E2 visa but you guys said its very unlikely to get approved for these under these circumstances

Good luck with your immigration case.  Be careful with that blood clot issue.  I'm not sure traveling is a good health decision. Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

See my post above. If it is urgent, then file ASAP, then request an emergency stamp appointment as soon as you have the receipt number (even if you don't have the physical receipt).

See above.

A tourist visa is NOT an option for you, as you are a permanent resident. If you relinquish your permanent resident status (either by filing an I-407, or with a final order of removal by an immigration judge) you would not be approved for a B-2 or B-1.

In immigration court the burden of proof switches.

Currently you are in the I-751 process where you have to prove your marriage was legit, but in court it switches to USCIS to prove - 'by clear and convincing evidence' - that your marriage was entered into for the purposes of evading immigration law. That is quite a bar for them to clear. 

That is a LONG way away, if ever. Just concentrate on now.

Don't rush into anything. This is a long, slow process, and you have absolute rights under law as a LPR. This stuff is a long way away. Just focus on now, and get that refile in so you can travel without worry for now. 

 

Trust me man, I'm going through the same hell (seriously, look at my profile signature).

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

@mindthegap Thank you! You are really inspiring me to fight this. I also wish you best luck! Today I am gonna meet my attorney first time after the denial. I am also open to other attorney suggestions. I heard about Hacking Immigration Law Group. Do you have a good attorney who knows how to defend me instead of just doing paperwork!

 

Im gonna refile and apply for an emergency travel document. Hopefully that arrives on time so I can take care of my health and business!

 

I am not entitled to get a b1 b2 now but I was thinking if I leave the country on my own without deportation, later on I can apply for a tourist visa once my permanent residency is final and ended.
