My K1 Fiance (Jinny from Thailand) arrived on Jan 22nd 2024. We were married on Feb 14th 2024 (Valentines Day) We are now on the adjustment of status journey and are confused as to what forms need to be filed.

We've been under the impression that we need to file the I-130 and I-130a and I-131 to adjust status to Green card. Now I'm seeing conflicting data concerning this. I've been questioning Why are we filling out the I-130 as it pertains to relatives and there are no relatives involved. Have more questions but this will start me in the correct direction.

Thank You for any information you may provide.

It's the I-485 you want to file.

There's a whole guide to it here on VJ. Check the tab in the top right corner for guides.

An I-130 would not be required if the marriage takes place within 90 days of entry into the US by the K-1 visa holder.  If the marriage takes place after 90 days, then an I-130 & I-130a are required.   But, of course, the visa holder would be out of status after that 90 days.
