Adjustment of Status Checklist

Hello everybody,

 

My wife and I are about to assemble our AoS submission. We have all of the following documents:

 

  • Payment
  • Cover Page
  • I-485
    • Entire form filled out and signed
    • Birth Certificate (English Translation)
    • Birth Certificate (Serbian)
    • Foreign passport bio page
    • Foreign K1 page
    • Foreign entry stamps
    • I-94
    • 2 passport-style photos
    • Vaccination records (medical was conducted in November)
    • NOA1 and NOA2
    • Certified copy of marriage certificate
  • Affidavit of Support
    • Form I-864 filled out and signed
    • Tax Return 2021
    • Tax Return 2022
    • Tax Return 2023 (Not sure if I'll be able to get this paperwork in time because I need an accountant this year)
    • Pay stubs for six months
    • W2 for 2021, 2022, and 2023
    • Income statement signed by my boss
    • Us Sponsor's Passport Bio Page
  • Employment Authorization Document
    • Form I-765 filled out and signed
    • Two passport-style photos
    • I-94
    • Foreign Passport Bio Page
    • Foreign Passport K1 Page
  • Travel Document - Advanced Parole
    • Form I-131 filled out and signed
    • Foreign passport bio page
    • Foreign passport K1 page
    • Two Passport-style photos
    • I-94
    • NOA1
    • NOA2

 

Is there anything else I should include or take out? Thank you all for helping us so much in our K1 and citizenship journey!

Timeline

You only need:

1. IRS transcripts OR

2. W2s + tax return

 

Not all. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

This is personal preference but just as an fyi regular photocopy is fine too

Do you not have transcripts? They’re much easier to read for USCIS and less pages. That would also eliminate the need for W2s. 
 

You’re only required to send the most recent tax return, we only sent the most recent one. It’s up to you of course but if you have entire tax returns that’s gonna be a lot of paperwork 

 

I wouldn’t delay filing just because you’re waiting for 2023 tax returns. It’s not required until after April 15

There’s no need for NOA1. Include NOA2 for I-765 too 

 

This is personal preference but I included a photocopy of a marriage certificate as a precaution because I changed my name and I wanted USCIS to see that because you never know with them
