How old are they? 

 

As others have said, this seems to be nothing to do with hubby.

I told her that she needs to stay on top of her case. Actually I am the one that pushed her to call or write USCIS. Unfortunately I can't be at her side when she'll make the call because I am in NJ and she is FL.

Several people have already told you that his conviction does NOT matter!!! It is HER visa, it's HER criminal record that matters!!!

I told her that I think that doesn't matter, but them think it has. Anyway I am told her all your comments about it.

If they do the congressional inquiry and 45 days later there is still no progress, they could submit a request through the USCIS Ombudsman:

Thank you. 

 

I've been reading about it. We plan to call USCIS ask for Tier 2. Wait for their response. If that doesn't work promptly we call to a congressional Representative and last, for the Ombudsman. Last night I read that we need to cope every step. On the Ombudsman page says they are now focus on the asylum first, the overdue case processing times takes more time to assign an officer.

 

I'll let you know how it goes.
