Hi all,

i wanna petition my daughter who is 14 years old currently i'm holding 2 year conditional green card in january of 2009 i will be elligable to remove my condition . I would like to know if it is ok for me to petition my daughter myself or would it be better if my husband petitions him. If he does then he needs to adopt my daughter right? Do i need to hire a lawyer or i can do it myself please give me some advise thank u ahead soo much for your time and answers. Also i dont know it is ok for my husband to petition my daughter because just recently he petiotioned his 4 kids from the phillipines about 5 months ago.

I am awaiting an answer for your question too as my husband (from the UK) brought over his son at the time he moved here (2005) and now his daughter (age 18) is interested in coming over. She was listed as his child on everything but no paperwork was filled out on her to come over when they did. I am confused when I read stuff regarding this. I know my husband, a PR, can petition for her (he also has his 2 year GC) but I can't tell if it will take the same amount of time it did when he and his son were approved (approx. 4-1/2 mons) or if it takes a lot longer (years). :goofy:

He can, if he used a Lawyer last time, then probably best to use one this tme as well.

How old was the daughter when you married.

Shari, You just need to submit an I-130 stating you as the petitioner, his daughter as the beneficiary (as your child) and file it where the instructions state depending on your area (along with the other supporting/additional documents as stated on the form). The US citizen can do this when the marriage occurs before the child's 18th birthday and is quicker since an immigrant visa number is immediately available to children of a US citizen (up to 21 years of age, unmarried, etc).

Since she is not in the US, you would just put the necessary consulate information where it is asked for on the I-130. It still does take a while, but not as long if he (the PR) submits an I-130 since she would be in a different preference category and would have to wait for an immigrant visa number. Once the I-130 is processed and approved then she will move to the US and then the I-485 will be submitted to adjust status.

:goofy: PJ - Thanks so much! We can go this route anytime from now until she turns 21 or marries, right? She wants to fly over in November for a month and I know if you start any of these processes it is harder to get in to the US for a visit as people can get turned away thinking they might stay, so we might start paperwork after she leaves in November. Thanks again! :goofy:

Yes...I believe once the I-130 is submitted the petition is considered filed at that age when it is filed (so if she turns 21 while in the process she can still proceed with adjusting status, etc).

i talked about it with my husband but he is not sure because when we were filling my papers my daughter was listed only under my name plus my ex husband takes care of my daughter so we dont know if my husband first needs to adopt my kid or we just need a permition from my ex. I dont know if people get married their step kids automatically becomes their kids?

At age 18 she is an adult and can live wherever she wants.

Very few people get stopped using the VWP on the basis of a filed application, and even is she got sent back there is no harm from the view of future immigration.

A 14 year old can be be petitioned by the USC step parent but would most likely require the parents permission to emigrate.
