Is it worth a try(split)

Hello, I got a question in connection with this topic, I guess. Briefly my situation: I came to US on visa B1…within 4 months I married a girl and applied for AOS…unfortunately she got cancer and died (on the day of our immigration interview, too bad).

I got a letter from USCIS latter on in one month that my application is being denied and I need to leave the US within 6 weeks which I did. This all happened 16 years ago (2008). MY QUESTION IS; Can I go to US now and apply for ESTA or tourist visa? Or I will be turned down anyway…Is it worth to try?

Thanks a lot ahead.

You can certainly apply for both

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

If it was a bonafide marriage you could have adjusted status as a widower on I-360. What was the basis of denial?

You can try applying for a ESTA / visa, but something tells me you may have a chance to be denied. Especially since you came before on visa and tried adjusting. Do you have established life and ties to your country?
