hello, i was a beneficiary of a k1 visa last dec2019 but was denied coz then fiance lacked some docs. given one year to comply but broke up along the way. now i have a new fiance and a new k1 application, NOA1 received Aug 2023 and is now waiting for NOA2..would my first k1 be a red flag for my current k1? this worries me a lot. if someone knows something about this, please let me know. would greatly appreciate it. thanks!

Should be OK.

However, why not marry and do CR-1 visa? It's cheaper and overall better than K-1

Make sure your current fiancé' knows the history of it.  He could be asked about it at some point.

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Yes he knows about it. told him right off the bat. would he be interviewed also? thanks for your response.

yes i will answer all questions truthfully. my current fiancé knows about it too.

the odds right now are very much in our favor. my ex-fiancé cheated on me with his ex. good thing it happened before it was too late. his loss🤪

some are just lucky to find the right person for them and wants to marry them. it’s not always about money and wanting to go to the US..i have a good life here but it would be better to spend it with someone who loves you and cares for you..i’m 54, a widow and    my kids are professionals already. it’s about time i take care of my life❤️

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I wouldn't worry about the previous K-1 in your case. You will be interviewed later. They will most likely ask you a question about the first K-1 case. As long as you answer the same way as here, you will be fine.

It would have been better to marry instead of file a second K1. But, a second K1 can be successful. 
Additionally, the extra documents required that led to the application on pause can also factor into the outcome of the second K1. 
If you have proof of your first K1 cheating I would take that to the interview.Don’t give it to the CO unless they request it though. 
If you tell us where you plan to interview this could be help give you a little more insight… but I wouldn’t worry about the first stage (USCIS) as long as you have submitted all the required documentation you should receive the NOA2. 
Currently, applications filed 8-9 months ago are being approved. So, (if things stay the same) you should receive a response to your application in April or May…

thank you for your message..i don’t have proof anymore of the cheating because i deleted everything. i was bir expecting to find someone else who is willing to take care of me. yes, we have submitted all the necessary and required documents. waiting for the NOA2, manifesting it❤️thank you!
