Do they know at customs that you are a fiance and waiting for the visa?

Hi all,

My question is... my fiance is planning to visit me while the visa process in going on. So far, we have just received our NOA1. He has family in a different part of the States than me, and will be flying in there as a tourist. When he goes through customs with his passport, will they know that he is in the process of getting a fiance visa? He was not planning on saying anything about me, just that he was coming to visit his family if they ask his purpose for visiting. I assume this will work?

First of all, it is not customs that will check your passport - it is immigration.

And yes, they will likely know, so it is best to be honest about his intentions, and carry proof of ties to home (letter from employer, landlord, return ticket, etc).

Yes, the information about the visa petition is available to the CBP agent but his plan is fine. He needs only to say he is visiting friends and family. He should have some evidence of his ties to home and intentions to return. This question comes up daily, so there's plenty of information on how to handle it.

I don't know unless it comes up in the conversation. If it sounds like you're trying to avoid answering a question, it's better to tell the truth. But if "visiting family" is all they need, you don't need to give out more information.

Bring lots of proof of ties to home and the I-129F package, including the NOA1. The border guard spent some time looking through my I-129F package when I entered the US while it was pending, and I think the amount of material in it helped convince him that I was doing things legally.

Hi,

Okay, I have visited my fiancee in the US after receiving the NOA1 without a problem. I told them that I was visiting her. It was no problem. What your fiance should do is have an itinerary of his trip indicating when he goes back. If you want to be on the absolute safe side some proof that he has to return (e.g. enrollment in school, job, etc.). I have never been asked for something like that except for an itinerary though. I would be careful with not telling the truth about the purpose of your visit. As I said, from my experience there should not be a problem.

What would the employment or landlord evidence look like? Could his landlord write a letter saying that he is paying rent while away for example? Also, he was planning on staying for 2 to 3 months, visiting me and his family. Will this rather long visit be questionable?

but i dont have proofs of ties to France to give really

I am not employed, I just work for a temporary agency and I don't pay a rent or anything since I live at my parents'

I am really scared of ruining everything :(

The worst thing that could happen is that they refuse you entry and make you go back home. If you can afford to do that then visit. It is unlikely that you will be refused entry. I have visited a couple of times and have not had a problem yet although they asked me a lot more questions when I went in May. I have another visit planned for the end of this month and I am keeping my fingers crossed that I won't have problems.

Once you book in with an airline, and your passport is scanned, the information is then sent over to the USA whilst you are in the air. By the time you get to the USA all the information regarding the passengers on that flight will be in their computer system.

If you have a K-1 application filed then yes, it will more than likely show up. This isn't anything to worry about though. When I visited my fiance during the K-1 application process I informed the Immigration Officer that I had a K-1 pending. She was fine about it, to be honest she didn't really seem to care.

I'm sure that other Immigration Officers will act differently but, at the end of the day, this shouldn't affect you visiting your fiance.

Take adequate proof of ties to your home country with you and enjoy your visit. :)

My fiance and I got our NOA1 back in May and we often worried about him visiting after it was issued. He's here with me right now, and had absolutely no problem getting in, even though we were both nervous about it. He had so many proofs of ties back to France, but never needed a single one. The immigration officer asked him why he was here, and he just said, "It's my vacation" and nothing further was asked and she wished him a good trip. That's not to say this will happen all the time, but it's good to know that there really are times when the K-1 doesn't even come up. Really, just answer what they ask you, nothing more. Also, I can't say I've heard of anyone from an EU country who also has a clean I-94 record having troubles visiting the US.
