Unfortunately (per my understanding), that is not how it works. People can and do suffer from USCIS mistakes, so really, it's on us to make sure we know the rules and make sure we do not benefit from inadvertent mistakes.

 

I'm happy to be coorected, but my understanding is that the general provision is 5 years. Period. Not 4 years and 11 months. Improperly obtained immigration benefits have been reversed, including citizenship.

 

I feel for the poster, but if I were that poster, I would REALLY endeavor to get that fixed ASAP.

No, you should keep them. At least you should make digital copies and store in the cloud. You never know if USCIS / DoS will ask you to prove you got citizenship correctly in like 20 years from now.

That’s not how it works. My original N400 was denied due to a USCIS mistake and error. 

  • Arrived to USA on F-1 Student Visa on 08/16/2016
  • Submitted I-485 & I-130 on 09/25/2017
  • Approved Green Card (IR7 category) on 05/17/2019
  • Electronically submitted N-400 (w/ name change) on 02/19/2024
  • Biometrics Reuse received on 02/19/2024
  • Interview Notice received on 04/21/2024 
  • Interview at Chicago FO on 06/10/2024 
  • Oath Ceremony on 07/15/2024
  • Applied for Expedited US Passport at USPS on 07/15/2024
  • PASSPORT RECEIVED on 07/26/2024 🇺🇸

USCIS won't take responsibility. Instead the person naturalized in error may get in huge trouble if tries to get a job or other benefit and presents as US citizen. Somewhere down the line, 10-20 years later etc, either SSA, DoS or USCIS may revisit their history and conclude they're not a US citizen. Then, if they apply for N-400 again, their claim to be a citizen will be seen as misrepresentation and potentially will mean they won't naturalize and can even lose their GC

They can take the civic test in their native language, and looks like they get the 20 question version:

Good morning! Happy Monday

It's been over a week since we had our combo interview (5/23). The officer said it would take a week to get our I-751 case over to his desk for approval. We received a notification last Tuesday stating that the case was transferred to the new field office. Has anyone had a similar experience? If so, how long did it take for you to get both cases approved? I'm unsure if we should follow up with the field office or just give it another week.

Since the I751 has already been approved you won't be interviewed for that application, it's done. However they could still ask you some questions about your marriage, even though you're applying under the 5-year rule, like they did for me. Just be ready to answer any question and bring some evidence of your continuing marriage (lease/house title in both your names, kids birth certificates, tax transcripts showing you filed jointly, etc.) Anything key document you used for your I751 but you probably don't need a ton.

I had a pending I-751 when I was interviewed for my N-400 case. My file was also in a different office so they had to request it to take action. I did not request for a combo interview but he said he will approve the I-751 case as well before he can approve the N-400 (he didn't interview my spouse). For me here's my timeline:

  • Friday: Interview. I also got the update on I-751 that it was requested to be transferred
  • Monday:  it was updated that the I-751 case has been transferred to a different office.
  • Tuesday: My I-751 showed that the card has been ordered. My N-400 was also approved and got my oath taking scheduled. 
  • Wednesday: I got the update that the I-751 case has been approved.
  • 1 week after: Green card was mailed (received after 2-3 days)

I think it depends on how quick they respond to cases because it looks like it moves forward as soon as they take action.

That's fast. I actually requested a combo interview when I applied for N400. Mine hasn't moved since last Tuesday after it got transferred to the office. I have a strong feeling he forgot about it or got busy. 🥲 I don't know if I should call the field office and do a follow-up or if I'm just being impatient?

It's hard to say because your office just might operate differently. For me, my officer gave me a specific timeline that he would probably have my records around Tuesday and he said he will approve it right away as soon as he gets it on the system. He might just be one of those people that really stays on top of things.
