I485 denied i130 pending

Timeline

Good morning, I just got a denial letter for my i485 and just found out that a rfe was sent to my old address a year ago that I did it even know about .I am still unsure if this is the real reason why I got denied because I submitted a ar11 form the same week I moved and got a confirmation email months before that rfe was mailed. Has anyone ever experienced something similar to this and what were the steps you used to overcome ? Should I reopen this case or just get a lawyer to take care of it

Do you know what the RFE was for?  If so, I would submit a new I485 addressing the RFE.

This is one situation in which I might consider filing to re-open. It seems it was a USCIS error. Besides, it costs a lot less.  Of course, you would still have to address the RFE matter.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

On the other hand, a denied 290B would still require refiling a new, complete I-485, I-131, I-765.

No I do not know what it was for , I even checked my uscis login to see if it was there and I see no rfe

In that case you may want to re-open the case with an I290.

So I did a FOIA request and what I got was a response stating reason for denial was “abandoned “ even tho I never abandoned the case I never got any mail or notification for any rfe

Seems logical to me. In USCIS eyes, an RFE was sent, you never responded, case got denied.

 

Now, it looks like you have proof of filing for change of address? If you decide to fight the decision by filing I-290b, you should walk USCIS through the timeline and explain how they denied you despite you notified them of address change.
