GC holder with a lot of problems

Hi guys, I would like to ask for your help. I'm embarrassed to expose the complicated situation in my relationship, but I hope I won't be judged. Sorry for the long text. Im a US/German citizen living in Florida. Im 60yo, my boyfriend is 29. Gay relationship, big age difference. We already have to deal with a lot of judgment

 

My boyfriend is a citizen of Brazil and has a 10-year Green Card ( he was previously married to another US citizen, who committed suicide in 2019 )

 

We have lived together since 2020, but he has serious mental disorders ( he is bipolar but I have a feeling he has schizophrenia too), and always goes through long periods of depression.

 

In 2022 he couldn't handle the pressure at work here in the USA, he went into a deep depression and went to stay with his parents in Brazil. He came back after almost 1 year (11 months outside the USA) because I insisted a lot for him to come back

 

In 2023 he left the USA to Brazil again and told me he would not return to America. He was in crisis again and this time he even tried to take his own life.

 

I went to Brazil 4 times to see him. And then again he returned to the USA (after 10 months outside the USA). This second time, I believe that because he was under a strong effect of medication (lithium, xanax), he was asked why he was absent, and he must not have given very clear answers (he was  in another "planet" when I picked him up at the airport). He wasn't sent to Secondary or anything like that, but he told me that the officer was very upset with him and very suspicious.

 

He was again in the USA. He didn't want to work or study (honestly he doesn't need to because I pay all the bills...also his family in Brazil has tons of money and they are always helping him ). I live in a more rural area of Florida, so he can't really walk anywhere. He is afraid of driving, especially taking benzodiazepines + lithium during the day, and he again went into a state of depression.

 

I unfortunately don't have  family or many people who can help me with the situation here in the USA (my whole family is  in Germany) and my parents invited him to stay with them for a while in Berlin. He is studying German (my native language because I was born in Germany and he always wanted to learn) Because I was afraid of him losing his Green Card (and after a lot of research) I applied for a Reentry Permit and then he went to Berlin ( he now has a 1 year German student visa ) . He has been there for 8 months and wants to return here now. Unfortunately the Reentry Permit has not yet been approved.

 

-Do you think he can enter the USA again? it would be the third time. The only difference this time is the pending Reentry permit.

 

- Is there any airport that is easier for him to enter? His last negative experience was in Orlando

 

- Should he just tell CBP the truth? that he was bored and depressed and he wanted an "experience" in Germany?

 

I do everything that I can to maintain his ties with the USA:  Tax returns, keep his bank account. I even keep his Disney annual pass (which is the only thing he likes here.  )

I'm actually planning to move to Miami in a few months because I think he'll be happier in Miami. He's a really good guy, he's just going through a difficult time. I wanted him here with me. I love him. He loves me.

He has only been gone for 8 months with a re-entry permit in process which may be one of the reasons he was given a tough time last time he entered the US, so I don't expect an issue.  I would make sure he has proof of his ties to the US as you demonstrated, as well as the information on the filing of the REP.  He may get questioned as to why so many trips to the US, and all I can add there is he should be honest.  Overall, he should be fine as it sounds like you will do what you can to prep him with the available proof of maintaining residence.  If CBP gives him a tough time, make sure he does not agree to give up his GC as there are stories of CBP doing this although I haven't heard of anything recently.

He just needs to get on a plane and fly to the US.  He has been outside the US for only 8 months.  Listen to @Dashinka

When he returns to the US, make sure you help him get the very best medical care you can afford, a psychiatrist, and a good therapist.  In Miami you should be able to find qualified Brazilian doctors and counselors who live there and practice.  If you really love him and want to be together, you will do everything you can so that he gets better.  It can be done.  My Brazilian husband was terrified of driving when he first arrived in California nearly five years ago (he had never driven a car before), and had an awful time adjusting to life in the USA, but with the help of a good psychiatrist and a Brazilian therapist, he overcame his anxiety and eventually got his driver's license, a job, and is now a US citizen, very happy.  Good luck!

I don't see any issues returning if he has been outside for 8 months. CBP can ask tough questions like they did the previous time but he will be let in. For future reference also note CBP cannot revoke his greencard; the worst they can do is refer him to immigration judge. You seem to provide him good moral and family/relationship support but please help him also get great medical support. Wishing you guys all the best.
