US Citizen sister applying for sister and sister family

The "each applicant" is for immediate relatives: unmarried children under 21, parents, spouse.   For family preference - married children, children over 21, sister/brother - there is only 1 application for the relative, and the relative's family are derivatives.

 

Your sister will be in the F4 category, and that is about a 20 year wait for a visa number.  And, unlike for immediate relatives, family preference does not forgive overstays and illegal work.  

 

The humanitarian parole program should allow your sister and brother-in-law to apply for employment authorization, by which they will also get their social security cards.  If they loose their authorized stay status, by expiry of the HP program or denial of asylum, they will need to return to Haiti.  Technically, they just need to leave the US.

They are already in the US. Wanted to know if they have to return to their home country while waiting for their visa at nvc to become available. Their country is very dangerous, people are dying cause of insecurity and wars

You petition your Sister, let us say a visa becomes available in 2055.

 

HP is good for 2 years, will there be a renewal opportunity, who knows.

 

There is TPS but as the name says that is supposed to be Temporary

Obviously your petition is a back stop and if they are still here is 2055 whenever and in status they could file to adjust.

When can they file for adjust status? In 2055? I thought they cannot file for adjust status until a visa is available for them, that is to say until 2040 may be.

And they have to be in status.

How do we know a asylum claim is practical

 

I agree with the children marrying USCs naturalizing and sponsor parents

Once the eldest USC kid is 18, join the military and get PIP.

 

There was an Eastern European poster on here or maybe Reddit.  Did the whole asylum thing after arriving on tourist visas.  Lost the whole case eventually, but not without popping out 2 USC kids. Kids turned 21 (they had immigrated to Canada) and then returned here to sponsor parents.  The poster was wondering if he could visit and adjust with Canadian passport.

There is the German family Biden is trying to deport, some children born here others who have married USCs
