Question/help with notifying USCIS Of divorce

Hi all,

 

So recently me and my wife got divorced, I just received the final divorce letter. I have a fresh I751 form that I can fill out, and submit a bunch of photos + statements and holiday notifications etc. But I did read that I can add the copy of my divorce letter to my current case? Is this possible or must I fill out and submit a new form? Because all I can see on my USCIS page is Case Was Received and I don't see a divorce file etc, sorry I'm just a bit confused right now. I appreciate the help.

How long is your existing I-751 pending? If only for few months, you can:

- submit a new one with divorce waiver and copy of divorce decree

- withdraw old I-751 after receiving new case

 

 

If it's been pending for a while, you can write to USCIS asking to convert your case. Include copy of extension letter and copy of divorce decree.

It's been pending since December 2022, sorry for the dumb question but is there an extension letter form that I must fill out? Or is this something that I can just write? must I send it to the location where my case is being processed or on their website? Again, apologies for the dumb questions.

Extension letter is I-797 you received after filing the I-751

Send the letter to the same USCIS office address on the 48 month extension notice (I-797), and request that they convert your joint I-751 to a divorce waiver.  Include a photocopy of the certified divorce decree, all pages.

Yes to all of the above …and 

Add additional evidence of joint life from Dec 2022 all the way to end of marriage .

 

Carefully look over your address /date of separation timeline and if you are the one who moved out of the marital home…hopefully you did an AR-11 and updated .

 

If break up was polite , try and get affidavit from ex saying marriage was in good faith, corroborate some details of past joint  financial decisions …but don’t stress if she refuses

Just to add, fill a new I-751 while at it and choose the "divorce option" check box. Add it to what @carmel34 said

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
