Submitting Affidavit of Support Submission in January 2024

Hello all,

 

I am a legal permanent resident living in the US. My wife lives abroad (Lebanon) and recently (December 2023) got her I-130 approved, so now we are working on the next steps (Affidavit of Support and DS-260). I will be sole sponsor for her as my income in the most recent tax year (2022) is sufficient. In 2023, I worked most of the year as a W2 full time employee until around July, then in November of the same year I began working as a 1099 contractor (self-employed). My questions are as follows:

  1. When filling out the Affidavit of Support, in the question related to total income (Part 6, question 24 a, b, and c) should I answer with the "Total income" value as presented in my 1040 forms? Or should I used "Adjusted Gross Income" instead?
  2. Can I submit the Affidavit of Support and DS-260 in January as soon as possible without having to wait for the 2023 W2 and 2023 1099 to come out? The reason is I want to submit as soon as possible, and the new tax year might not start before the end of the month. I already provided documentation (Pay stubs, bank statements, employment letters) that prove that I have made more than enough in 2023 to cover sponsoring expenses. I can explain all that in Part 11 of the Affidavit of Support, but I just want to know what is the best course of action here

As you've got a long time to wait until she'll be able to get a visa, personally I'd also wait to submit the AOS and DS-260 - you might as well hang on until you've got the 2023 docs, as it won't impact anything if you do wait.

@Boiler I-130 was submitted in February 26, 2022. It was approved in early December 2023.

 

OK, so many years away from getting a visa, as you've got plenty of time you can wait until you've got the 2023 docs to submit them too.

You have a few years to go so not an issue for now.
