My wife's passport already has her maiden name on it as sheshe got it before she even met me. Should she get a new passport with her married name? Will the name on the visa be her married name ? She is already using the married name for everything.

Hello,

I believe the visa will be issued based on the name in her passport and it does not matter whether it is her maiden or married name. So unless she wants her visa to be issued in her married name, I wouldn't worry about it. My personal opinion, however, and this is only because I considered changing my name too, is that if it is fairly easy in the Philippines to get it done then she should consider it. Apart from the fact that the name change can be used as evidence of a bona fide relationship, you say that she is already using her married name for everything else so it may be sensible to have her visa issued in her married name. ;)

Edited to add: This is the website that I got the info from. Look under the heading "Married Females". I'm not sure though whether she can change her name now that your petition has gone in. You may want to call and ask?

Are you sure this is absolutely correct? We are applying for CR1 and do not intend to change the (maiden) name in my passport for the purposes of the CR1 application because the process takes too long in my home country. Please could you let me know where you obtained this information from because it is quite worrying. Thanks.

KTG, I emailed my consulate some time ago asking the same thing and they told me that as long as my passport is valid for 8 months at the time of visa issuing it is no problem whatsoever it's in my maiden name. Maybe it differs from country to country though; I'd contact your embassy/consulate to be sure.
