It is odd that a K1 is a good option, certainly from the UK, so my impression is that we are seeing fewer of them

The ones I have seen for the first stage have been just under a year.

Yeah had I know it wasn't going to be as simple as file and wait and then follow instructions, I would have just urged him to come to the UK instead. We just want to be together but I think he prefers the US which I don't blame him with how much I complain about London overcrowding and tubes haha!

I think more people are going down the Spousal route.

I thought that might be the case. We wondered if perhaps the address is wrong on the actual original letter (the one that keeps being sent back and forth) since we have easily received copies of the NOA1 from USCIS. Perhaps we get USPS informed delivery, call USCIS and get them to check the address on the letter, put my fiance's name on the letter box and just hope that works?

Correspondence for a K-1 petition should be addressed to the petitioner, but if you expect any mail for the beneficiary you should absolutely put their name on the inside of the mailbox, too. If the address is eligible for Informed Delivery you should absolutely sign up for that as a general best practice. Finally, is the address they sent the NOA1 to formatted properly based on the USPS database (which you can verify in the USPS “Look up a zip code” tool?

Calling USCIS is clearly not helping here (as is often the case), so if you think something needs to be done other waiting patiently perhaps you could send a letter to the USCIS office address listed on the NOA1 (including a copy of the NOA1 and referencing the case number, petitioner and beneficiary name/DOB in the header) explaining the situation as clearly and succinctly as possible. If you did go that route (which I’m not sure many would recommend) I would keep things short and sweet and not expect a reply.

We just want our status changed back to 'Case received' so we know our petition is going to be processed at the right time and not get cancelled. Should we be requesting a Tier 2 officer this time? Do we take this to our congressman?

Just a few other thoughts:

- As a general rule I wouldn’t expect anything useful to happen when calling USCIS unless you talk to a Tier 2 officer.

- Based on experiences posted on this forum I would not expect much to come out of contacting elected representatives.

Edit: and finally as mentioned earlier, you are still well within processing times as posted on the USCIS website (15 months).

According to TMVN it should be around April-May we will hear something. I understand this may not be the case I'm not complaining about the time I have to wait at all. Tbh I don't mind waiting longer than that, my fear is just that some weird admin error has happened and we will never get seen to.

I feel like there is some unnecessary bad feelings coming from people in the replies. I am only a confused and scared beneficiary trying to navigate this long process like everyone else.

I am simply just someone who wanted to do what everyone else did and wait a quiet 12-15 months but we can't seem to get this situation behind us.

How was my comment an “unnecessary bad feeling”?

it was not clear from how you worded things that you realized, based on current processing times, that your petition has awhile before its adjudicated.

We get a lot of new members who choose to do a K-1 without understanding current processing times.

good luck.

and then being told if we don't do something our petition will be withdrawn

Where does it say that? Sounds like a boilerplate disclaimer, not something actually relevant to your case.

You should definitely talk to a Tier 2 officer to hear from them directly what is almost certain - that your case is being processed and that nothing else is required from your end at this time - because you're clearly worried. This should put your mind at rest.

So best thing is to call USPS? The mail USCIS send is not tracked so I feel like this will be tricky. It just seems weird that the same letter keeps getting sent back but we have received everything else totally fine. I wouldn't be bothered at all if it wasn't for USCIS saying that they will cancel the petition if we don't sort it.

Do not call them, go in person.  Your local postmaster will tell you how to address/fix the delivery problems.

K1s are still a process that works for some people. We certainly did it. Not sure I'd have done that knowing what I know now, but hey it is what it is.

Anyway this does seem like a postmaster issue, so I'd head over to your local post office and see what they'd suggest. I always get very confused by people saying they need to have their name on the post box - in all the years I have lived on this rural route we only have the house number on the box. Now of course our mail service has always been terrible (bunch of knuckleheads that can barely pay attention on a good day), but they never lost, misdelivered, or rejected any official documents and certainly not a USCIS item. BTW, I'd suggest the OP sign up for informed delivery - that shows you what's coming, which means you can see when the postman 'forgot' to deliver something.

Thank you! We knew the K-1 visa would allow us to be in person quicker than saving and planning for a wedding, doing said wedding and then waiting for the CR-1 (also we have only been together a year getting married so quickly would just look suspicious in my opinion). Plus I am interested in some forced time off work (I am a burned out teacher!), I don't drive anyway, have no issue having to stay in America whilst I wait for a green card. Having the inability to work will help me have that sabbatical I've always wanted and allow me to settle in and think about a career change without the financial pressures or feeling guilty. So the K-1 is definitely best for us we just weren't expecting to run into THIS issue!

We are going to sign up for informed delivery, put the name on the post box and will call USCIS to ask if there is a problem on their end next month. We are going to see if these repeat status changes might just be an admin error and so we will wait to see if it irons out first. I know my fiance won't bother going in person (he won't even know who the local postmaster is) but if it happens to us again I will force him to do it haha!
