EB-5 Immigrant Investor program

Timeline

I am from pakistan. my uncle applied for EB-5 Immigrant Investor Program and paid around 500,000 dollars fee but he has died a month ago during the pendency of case. I wanna know whats the procedure for reimbursement /withdrawal of that amount which he submitted for the petition?
he was un married and he had no kids . 
list of his heirs
Father
Step mother
two brothers
3 sisters.

your uncle must have signed an investor's agreement. that agreement will dictate when the money will be returned. you need to read the agreement and reach out to regional center .  this is not an immigration question though

You have asked for specific answers and provide no information.

 

Generally I look at an EB5 as buying a Green Card any money you get back is a bonus. He must have applied sometime ago through a regional scheme with that amount. You do not even mention the scheme.

 

You mention you have a Lawyer who presumably have perused the terms of the agreement, there are exit clauses and I would think it very unlikely your Uncle would have invested without both legal and financial advice so I would start by contacting those advisers.

EB5 is notorious for locking down the money. most likely uncle must have invested money in regional center. They usually have a lock in period for 5-7 years for the money or until the applicant gets their Conditonal green removed but at no point are they required to return the money before maturity. 

 

in this case , they need to approach the regional center for the refund but the regional center has no obligation to return until the 5-7 year period. everything matters what was written in the contract
