Having to resend whole package

My application was received by USCIS on 01/02 and when I woke up this morning I saw a declined transaction of $680. 
 

I used credit card transactions for all my forms (I-129F, AOS and so on) and never, ever had any issues. 
 

To my horror, this happened when my green card expires on 01/18. 
 

Besides the fact that I had a slight mental breakdown, I had to call off work and I am now re-printing my whole package (over 500 pages) and re-sending everything today with overnight shipping and a cashier’s check. 
 

I guess my question is, there shouldn’t be any issues with a cashier’s check, correct? 

Also, assuming the other application will be sent back to me with a rejection notice due to lack of payment, could this cause problems with the new application I’m sending out today? 
 

I might be paranoid right now but I am concerned about the fact that I have a tight timeframe.

I would call the credit card company and make sure they decline any other attempts from USCIS for this transaction.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you for the suggestion. I was under the impression that USCIS only attempts one transaction and if that doesn’t go through, they do not try again. Isn’t that the case?

Yes, that is their official policy.  Did you get a notification that USCIS rejected the I-751?

No, I did not get any notifications, just an email from my credit card saying that the transaction was declined. 
 

As soon as I saw that I figured I would resend everything ASAP to avoid further delays, hoping that at least I will have an e-notification before my green card expires. 
 

To confirm, cashier’s checks are safe when it comes to USCIS I assume?

Why not just use a personal check so you can see when they cash it, and have proof as well?

Unfortunately we would have to order the personal checks and my bank confirmed it would take one or two weeks, and I’m unable to wait that long. 
 

Also, according to my bank since the money is guaranteed with a cashier’s check there shouldn’t be any issues, but I was wondering about other’s experiences.

Cashier check is fine, it is just not as good as a personal check when it comes to knowing when it was cashed, having proof of such, if it gets lost, etc...  Many people seem to use it.

Oh, some banks give you starter personal checks the same day as when you open the account, or can even print some on the spot for you.  However, I don't know if using a starter check would pose a problem or not since it doesn't have your name printed on it etc..

I would wait until it gets returned to you, which should be soon. Every page will be stamped, and there should be a slip with it.

Just keep it as it, simply add a new credit card card page or cheque on top, plus an extra cover letter (stating that it was sent and returned for denied payment) and all will be well. 

 

Relax. It will not be considered late.

 

1- Your proof of status (ie, your card) may expire on January 18th, your status will not. 

2 - Read 1 again.

3 - Repeat.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thank you for your response and for the reassurance. I’m currently halfway through re-printing my package and I really don’t want to wait to send it out, however should I include a letter stating that this is a second submission as the first one was rejected due to declined payment?

Thank you, I will try to relax a little! 

 

Well it technically hasn't been rejected yet, as you haven't got it back!

 

Yes, you know it has been from the declined charge, but just let it play out. They have a procedure for this, they stamp everything and send it back to you, and you just edit what needs editing, and resend it. 

 

Again, the card is proof of status, and not the status itself. It will not be considered late, it will not be refused, you won't be deported.

Due to my anxiety I just could not wait lol, I re-sent the whole package and I included a cashier’s check. I also added a short statement explaining how this is a second submission as the previous one had a declined payment. 
 

Honestly I’m not sure if it’ll make a difference but I figured it couldn’t hurt and the sooner the better. 
 

USCIS seems to be processing mail pretty quickly nowadays and I’m hoping to have some news by the end of this upcoming week.
