Graduate student without income but joint sponsor!

Hi all,

I have four questions about the visa process and hope you can help me out with one, or all, of them!

 

I am a law school graduate sponsoring my wife's I-864 application. I had no taxable income the past three years while in school and am currently unemployed but slated to take my state's bar exam, so my prospect of earning income is good. Does NVC weight a sponsor's earning potential or is it irrelevant?

 

I have my last tax return from years prior but it seems like I will need to attach an explanation for why I had no income the past three years. I suppose I would attach that in the "Additional AOS Supporting Documentation" and not attach any tax return or transcript. Is it okay if my tax return/transcript is missing when I submit or is there anything else I should provide?

 

To supplement my lack of income, our application has a joint sponsor well above the required threshold. Does having a qualified joint sponsor effectively guarantee the visa will be granted, or am I missing something?

 

My wife also has the possibility of continuing her employment once she moves to the U.S. So we could go through that paperwork that her income would continue, but is proving continuing employment even necessary with a joint sponsor?

2. Just check the box that says your income was below the filing threshold.

3. No positive guarantees.  Not having a qualified sponsor guarantees NO visa.  

4. If your wife has actual evidence her income will continue from the same source, then do that instead of having a joint sponsor sign a binding contract.  The affidavit of support is not just about showing somebody is qualified.  You graduated law school.  Would you advise signing that contract if it wasn't absolutely necessary?

Facts are cheap...knowing how to use them is precious...

For 2 I can check "Document Not Available" then I just type the reason in the comments I guess. I was unsure if there was a better method to get rid of the "MISSING" designation.

 

For 3, I know that there are no guarantees but the joint sponsor is such a saving grace for me that I am anxious about its general efficacy.

The joint sponsor is filed and ready to submit, courtesy of a close family member. I have confidence in the particulars of my family, even if I would not advise the same for everybody.

 

I hope to move ahead of my wife and land a job, and therefore an income, so maybe I will have some pay stubs come interview time.

For 2, according to you, you filed no tax returns in the past three years, because you had no income.  Based on that, I gave the proper advice already.  Documents that never existed, are not "unavailable".  They don't exist.
