Hello,

We have filed for the K-3 visa and I have been trying to update my personal timeline with the I-130 NOA1 receipt date, but for some reason, once I fill the field out and submit it, it says there has been a date problem and highlights my I-129F date and the NOA1 receipt date for my I-130 in red.

Is this because, the dates for the I-130 and the I-129F being sent out are the same? USCIS had asked K-3 visa applicants to send both the I-130 and the I-129F together before the July 30th change in fees deadline.

7/16/2007 - Sent I-130 Package to NSC*

7/17/2007 - Received at NSC

7/25/2007 - Case transferred to CSC

7/26/2007 - NOA1 sent

2/12/2008 - Approval email received

2/16/2008 - NOA2 Hardcopy received

I-129F

7/16/2007 - Sent I-129F Package to NSC*

7/17/2007 - Received at NSC

2/26/2008 - Petition left NVC

2/28/2008 - Petition reaches Mumbai consulate

5/06/2008 - Interview-Visa granted !!!

5/07/2008 - Visa received by courier

5/21/2008 - POE at JFK

AOS/EAD

5/27/2008 - Applied for AOS/EAD

6/28/2008 - Biometrics-DONE

9/20/2008 - EAD card received in the mail

1/20/2009 - AOS Interview at San Antonio-Approved

1/20/2009 - Card production ordered

10/20/2011 - Note to self: Removal of Conditions Filing

1/23/2009 - Welcome to the Unites States letter received

1/30/2009 - Greencard Received in the Mail !!! Yay !!!

The code requires the I-129f filing date to be after the I130 filin date. This is based on the fact that the I-129f form says you have to provide proof of having filed an I130 previously (submit a copy of an I130 NOA for example). To do this you would have to file after the I130 to have already received the I130 NOA. If this is wrong let me know.

This is based on the fact that the I-129f form says you have to provide proof of having filed an I130 previously (submit a copy of an I130 NOA for example). To do this you would have to file after the I130 to have already received the I130 NOA. If this is wrong let me know.

What you have mentioned is true in almost all cases. However, recently because of the change in filing fees for the I-130 and the I-129F, some of the K-3 visa petitioners called up USCIS to clarify how the change in fees would affect those filing the I-130 before July 30th and the I-129F after July 30th. We were told (I know of two other petitioners atleast) to send both the petitions together with a cover letter explaining the reason as to why they were being sent together. Which is why, the date for sending both our petitions (the I-130 and the I-129F) out is July 16, 2007.

It's wrong now, because as The-wait-is-on says the two forms can now be submitted concurrently. The proof of filing the I-130 for the I-129f is that the fact that the I-130 is right there with it (similar to concurrently filing I-485 and I-130 by someone who is adjusting status from something other than K).

You should adjust the code to permit the I-129f filing date to be the same as or later than the I-130 filing date, but continue to reject I-129f filing dates that are earlier than the I-130 filing date.
