Are all requirements met?

Timeline

Hi there,

We're seeing the light at the end of the tunnel here, I think, with my interview coming up later this month. Being a worrier, however, I'm still wondering something.

After we filled out the I-864, they sent back a piece of paper saying we didn't prove that my husband's domicile is the US (we're temporarily living abroad). So we wrote a letter, sent bank account statements, etc. Very soon after, they sent another identical piece of paper, once again stating that we didnt prove the domicile thing.

But then things came up and before I had a chance to get back and try to prove this thing again, my intervew appointment letter arrived. So now I wonder - does this mean that the second letter was just a reminder before our letter arrived and then they got our evidence and all is well - or not? Would they invite me for an interview if not all paperwork were in order?

I suppose I'll find out the answer in a month but if someone could save me from four weeks of worrying, I'd really appreciate it. Thanks.

July 2004 - Married

September 2004 - Filed I-130

Early October 2004 - Left the USA

October 12, 2004 - I-130 received

March 16, 2005 - I-130 approved

February 2006 - Filed I-824 to request handling in London

February 16, 2006 - I-824 received

July 26, 2006 - Received another approval notice for the I-130

August 2006 - Received form for Choice of Agent and Address form along with a visa process map of sorts and a request for an Affidavit of Support Fee Bill. All sent back right away.

January 10, 2007 - Filed I-864. At some point in time, we received a checklist back saying that we did not prove US domicile.

February 12, 2007 - Agent received an instruction packet detailing the documents to send back and those to obtain

April 29, 2007 - Filed DS-230 Part I as well as further evidence for domicile-issue (including evidence of address and bank accounts)

May 22, 2007 - Received another checklist saying we have not established US domicile

July 22, 2007 - Received appointment for interview for late in August, which later got pushed back a bit

September 4, 2007 - Interview date

Don't know about your country but in the Philippines USEM is very strict on peeps showing valid domicile.

LOTS have been denied visas for lack of such!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

:time: It really does help us to help you. As beckypua says above, the Phillipines are strict about domicile of the USC; on the other hand, London is well known for being extremely lenient about such matters. Every consulate has its own quirks -- what country are you filing from?

Um, timeline, hm. I must admit I'm not nearly as on top of all this as some of you here seem to be. Our I-130 was mailed in nearly three years ago and the agony of continuous paperwork has been going on since, with serious gaps on our part. After marrying in the States (where I was on a student visa at the time), we left to live in the UK (where we are now). We have, however, kept up an address and several joint accounts in the US with the full intention of moving back at some point in the near future.

As for place - at one point during the process, I requested that my paperwork be handled at the embassy in London, and yet, just now, I was notified that my interview will take place in Hungary, where I am from. I do wonder where my money went, really.

Anyway, I was reading around the site here and elsewhere and have found that paperwork only gets forwarded to the embassy when it is complete - so I am hoping that that means that the domicile question is settled. Or should I expect the interview to be rough?

Below is as close of a timeline as I could look up. Thanks.

July 2004 - Married

September 2004 - Filed I-130

Early October 2004 - Left the USA

October 12, 2004 - I-130 received

March 16, 2005 - I-130 approved

February 2006 - Filed I-824 to request handling in London

I wonder if this applies in your case? Just something interesting I found when looking for information on domicile. It's a bit confusing as, no the one hand they say they will forward it to the post and in the next sentence they say they wait a year for it.

9 FAM 42.63 PN4.1-2 Incomplete Cases or Cases Lacking Documentation

(TL:VISA-583; 10-14-2003)

If the case file is incomplete or lacks proper documentation, the NVC will send a checklist to the petitioner, agent or applicant indicating what changes are needed. The petitioner, agent or applicant will be told to return the required information to the NVC. If the NVC determines the case is still incomplete, a second checklist will be sent. After two reviews by the NVC, the file will be forwarded to the post even if it still contains errors or omissions (provided the petitioner has at a minimum submitted and signed Form I-864). If the petitioner, agent or applicant does not return the documents within one year, the NVC will initiate the administrative process for post to begin case termination.

Just wanted to wish you the best of luck with your interview. Since you have got the the Embassy stage, that is a good sign. However, it looks like NVC still has its doubts about the domicile issue, and this may therefore be a part of your interview. Make sure you are as prepared as possible for the interview and take too much evidence rather than not enough.

I think I remember that you are living in the UK. What steps have you taken to re-establish domicile? Pull out every scrap of paper you can find to take with you, and again Good Luck :thumbs:

Hi essjay! Many thanks for that. Someone here told me about a month ago (in response to my whining about how slowly the four weeks until the interview will pass) to just wait, it will fly by and I'll be at the embassy before I know it!

Well, respectfully, they were wrong. Never have I had such slow weeks as these. I'm more than a bit nervous.

Either way, to answer your question, we've got several bank accounts in the US and in fact, we just opened up a CD there and shoved a good chunk of our money in it - I'll have statements for all of those. Most of them go to the address we've kept up there - some come here to the UK. Then, we've got a letter from the family business stating they'll hire my husband as soon as we're there (which is completely true; he wants to join them). Hm, what else? Letters from family saying they all think we're smitten and are looking forward to our upcoming move to the States. Don't have anything regarding accommodation as we'll spend the first time with relatives. And a copy of the temporary visa my husband has for here (even though that's good for another 4 years or so).

That's about it - any other suggestions, perhaps? Anything is welcome.

If you can get it, something in writing confirming what your new address will be might be helpful. We took along a letter from the owner confirming that we would be staying there until we found a new place for ourselves. :idea:

In our situation, we had exchanged contracts on our house and booked a shipping firm so we took along all the paperwork for that.

In London, domicile wasn't actually mentioned, but we were DCF. It did feel good to be overprepared though :lol:
