Hello all. I have a question. I came on a K1 vsia and  received my 2-year GC on 03/28/2022. I applied last December for the 10 year GC and my case is actively reviewing. When am I able to apply for the citizenship?

If the Resident Since on your GC is 03/28/2022, you can apply for citizenship under 3 year rule on 03/28/2025 minus 90 days, which is 12/28/2025. Considering it's a Saturday, I'd just apply the first week of January 2025.

Make sure you have at least 18 months of presence in the US, never had trips over 6 months and your marriage is strong and bonafide. E.g. you never separated from your US citizen spouse etc. They also need to be a US citizen for at least 3 years when you apply.

  • 4 months later...

Thought I'd check in on our little thread... anyone with any updates?

Been absolute crickets for me since January. Since we're fast approaching a year of waiting at this point it naturally poses the question of whether to apply for naturalisation or not.

Since Germany did away with the huge bureaucratic hurdles to keep citizenship earlier this year, I have been umming and ahhing about filing next year. The thought of never having to deal with USCIS is quite lovely, but having to deal with the IRS for the rest of my life certainly isn't 😅 still not quite sure what to do at this point c.10 weeks out from potential early filing so if anyone has any interesting reading on the topic please do share.

I-751 can technically take 2-3 years to get approved. There's a reason why USCIS issues 48 month extension letters as oppose to 12, 18 or 24 months like they used to.

Don't apply for naturalisation, this is a British or Aussie term. This country uses naturalization.

If you never want to deal with USCIS again (outside of petitioning others), I highly recommend getting naturalized, especially with German laws allowing it now.

I'm aware of the I-751 processing times and aware of the British vs American English - I simply prefer the s vs the z as that's what I'm used to. Not sure what either has to do with my post or hypothetical questions quite honestly.

I can tell you that being rid of USCIS is a great feeling.  After 40 months of waiting for wife's I-751 to be processed, she filed her N-400 (5 year rule).  Four months later, both the I-751 and N-400 were approved after a combo interview.  As far as the IRS is concerned, you still have the same obligations now (as long as you are a Green Card holder).  Good luck on your decision.  But, as I said, being out from under the thumb of USCIS is great.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think you meant he can apply 12/28/2024?
