The Fifth and Fourteenth Amendments both contain a Due Process Clause, although the Fourteenth Amendment applies explicitly to the states.

Why did the Colorado Supreme Court issue an immediate stay?  Why did this court ignore Due Process themselves violating both the 5th and 14th Amendments?  Why hasn’t Jack Smith charged Trump with insurrection?  Why did the Colorado Court rely on testimony from the Chinese spy Eric Swalwell?

Alan Dershowitz, who is certainly no Trumpster,  disagrees with you.  Article 5 specifically says "The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article."

How often has Dershowitz been correct in his views.  All laws are up for personal views but it will take the US Supreme Court to look at the way the Amendments were put in place and look at the reasoning behind them, not a personal view. Personal views and opinions are why this country is in the issue it is currently in. Letter of the law is what it comes down to and not an opinion.

I could say I am almost always right, yet my wife will tell you different. Every constitutional scholar has there own opinion and view. What it comes down to as I said is the letter of the law and the reasoning for it at the time.  Twisting it to fit anything else is incorrect.

The big question that will need to be answered is what constitutes an insurrection.  Does someone need to be charged with and convicted of it to trigger the clause in the 14th.  I do wonder what SCOTUS will do.  Can they simply punt and leave the CO SC stay in place?
