i-130 got approved, Questions (Merged)

i am a US citizen living in the USA. MY wife is Vietnamese living in Vietnam. Meet in 2020, married in 2022. Filed i130 nov 2022, approve dec 2023 and now in NVC process. 

 

so a few questions:

 

1)  If  i upload recent 1040 tax return form, and need to upload w2 and 1099-c form for trading accounts, does it need to be one pdf or can it be different PDfs and upload each?

 

2)  I should upload 3 years worth of tax transcript?

 

3)  MY sister is my joint sponsor, does she need to file out her own i864?  She filed married jointly with her husband, does her husband need to file an i864a even though my sister’s income alone is more than enough to do a joint sponsor with me: Does he need to show 3 years of w2 also?

 

4)  Does my sister need to include a cover letter stating we have a bonafide marriage?

 

5)  Do I need to upload a timeline/statement of bonafide relationship showing pictures and describing places we went to like I did when I did the i130?

 

6)  We married in 2022 and I recently came back a couple of months ago and my wife is now pregnant. On my i130 I created a document and updated timeline statement showing our recent trip and also evidence of her ultrasounds from hospital and pregnancy tests and it got my i130

expedited.  Now how do I upload these same documents to prove her pregnancy on the NVC site and also how can I expedite our case? Do I have to call or email them?  Thanks

 

7)  My i864, I need to print it out, sign it in black pen, and rescan it?  My joint sponsor needs to do the same? I have Samsung tablet with pen, can I just use that to digitally sign with stylus?

 

8 )  For proof of domicile, would a driver license and banking statement suffice? 

 

9)  ON THE i-864 it asks for A-number or uscis number for my spouse , is the uscis number the on that is on my approved i130 form? Is that the receipt number?

 

10)  For” Part 3: information about the immigrants you are sponsoring” I chose “ I am sponsoring the principal immigrant named in part 2”. So for Family member 1, 2, etc…Do I have to put “Not applicable” or can I just leave blank?   I wife told me that even she read that even though for part 3, they someone chose the same option as me and left the family members blank since they are not sponsoring another else, but for some reason the form got reject and people told her it’s better to put “not applicable” instead of leaving blank, is this true?

 

11)  FOR “part 6: sponsor’s employment and income” I am only sponsoring my wife over so I check box 22 correct, where it says “one of more people listed in item numbers 8, 11, 14, and 17 do not need to complete form i864a…”? or just leave it blank?

 

12) For the tax part, I needed to include 3 most recent AGI and for 2021, my adjusted gross income was -3,000 because I didn’t have income but took a $3,000 capital loss deduction.  However, I cannot enter a negative number in this section, so how do I do it? Do I just put zero?

 

i have a question about the TAX income portion for the i-864. In 2021, my adjusted gross income was -3,000 because i had no income but i took a $3,000 capital loss due to stock loss. The problem is that i cannot put negative sign on the form. So what do i do here? my 1040 states -3,000 AGI, do i just put $0 in the i-864?

 

3) Also i looked at my tax transcript and i noticed they spelled my first name wrong on the IRS transcript, MY first name is 5 letters and they are miss the last letter of my First name.  IS there a character limit on the IRS transcript name? why is my first name missing the last letter of my name? I checked my 1040 forms from the years and it's spelled correctly, so why is my first name spelled incorrectly? What should i do in this case? Just use my 1040 and not use the tax transcripts because of the discrepancy in the name?

Also is there a year limit to transcripts that can be downloaded? i noticed my goas back only 2019, even though i've sent my returns for years before 2019 too..

1) I filed my tax late for 2022 and also filed also filed "married filing separately" so i had to paper file it, and the IRS has not yet received or processed my 2022 tax transcripts, so can i just use my 1040 tax return as a replacement for the tax transcript for year 2022?

Is that the USCIS notice receipt number beginning with IOE? Where do I find the USCIS number if our i-130 was just approved and we are in the NVC Stage now?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That's a lot of questions, most of which are answered well in the official instructions you download same place as the form(s).  First, become an A-Student of those instructions and the form itself.  You may still have questions and we'll be here for you, but this is a do it yourself site, with emphasis on the "do it" including your "homework".

 

If you need a joint sponsor, and they are married, the complete their own I-864 and it is best practice for their joint tax filing spouse to provide an I-864a, whether they have income or not, and whether their income is needed or not.  It's a contract.  Consular Officers want both spouses to sign it.

You cannot expedite for pregnancy.   Sure, you can ask- but don’t be surprised if they refuse.   And HCMC is not an “easy” consulate.

Some general help. The form works best when using Adobe Reader or Acrobat.  Anything you must enter but cannot type in the form, can simply be hand written after printing.

 

The only reason to send more than the most recent tax return would be if it makes things look better.  Sounds like it won't.  Adjusted Gross Income is not what you use.  Use "Total Income".  Yes, sometimes it's the same number.
