Hi fellows!

I filled the petition for my fiancee about a year ago, and she got her visa in January 2007, she came here to USA in march and we didnt get married. She came back to her country (no overstay) but I want her to come back to me. Is it possible? I dont want to wait next 2 years. What should I do?

You need to include a wavier, or get married and file for a spousal visa. Take a look at the IMBRA forum. Spousal visas are exempt from the IMBRA limitations.

file again for a k1 and include a waiver request.. Gettting married is no quick fix. it takes a much longer time

We were in the same situation as the OP. We consulted with a couple attorney's. They all thought that we didn't need a IMBRA waiver, since I would be petitioning for the same fiance. But USCIS's implementing regulations have language slightly different from the governing legislation and it is a little controversial whether a IMBRA waiver is required.

One of these two lawyers told me that she was concerned that we might get hung up at USCIS for a very long time as they asked questions basically to the effect, "Are you really going to get married this time?" So we got married and are taking the K3 path.

It really is not easy to predict which path would have been faster or slower -- we took the path that seemed to us the safest.

1-18-2006 She returns to Russia, engaged but not married
