Hi,

 

I recently entered on IR1 visa for the first time, which activated it and I got my passport stamped for the i551 endorsement. 5 days later, I went to DMV to get my DL, but was told I need to bring printed i94 form. From my understanding, however, i94 is not issued to LPRs, and was therefore confused about this requirement - and indeed, my i94 record doesn't show my last entry on IR1 visa, but shows my almost 1 year old entry on ESTA. After printing it out, the DMV employee said she cannot accept that i94, as it doesn't show the correct status, and that she won't be able to issue me DL without the "Admission number". She said to wait a week for my i94 to update.

 

What is the correct procedure here? I believe the DMV employee was wrong, as the i94 won't be updated with my entry on LPR status. I can also see my last entry correctly listed under 'Travel History', but that is not part of the i94 form.

The DMV employee was wrong.  Go to another DMV or wait until you get the plastic Green card.  You will not have an I-94.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Did u mark ds 260 for the SS #? it does help to have the SS card but we didn't need it for DMV here

 

I did follow all the requirements, I had all the right documents, i94 was not on the checklist, but she insisted that she cannot proceed without it.

 

Edit: To be specific, she said she cannot proceed without the Admission ID, which was previously written under the stamps when entering as non-LPR (ie ESTA). My i551 endorsement stamp has only the date of admission, but no Admission ID.

Yes to the ds260, however I already have SSN (from my previous stay on work visa). I even have expired Read ID, so I was just "renewing".

I have seen several instances of various agents mistakenly following procedures for someone who is "in the US on a visa" because they see a visa in a passport and don't know any better.  What has to be explained to them is that it is no longer a visa at all, it is a temporary I-551 Green Card. So they must follow whatever the procedure is for a green card because it is NOT a visa, it IS a temporary I-551 Green Card.

  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

she's wrong 

I 551 stamp and proof of state residency like mail in your name is what most states need 

i don't know yours 

if your city is big enough to have more than 1 DMV,  try another /if not do as Crazycat says and print out the page 

don't be afraid to ask to see a supervisor/u have the same rights as a USC except voting and certain jobs

The DMV person didn't know what was required.  You know more than she does.

 

I have a letter from a state agency who reviewed my mother-in-law's IR-5 visa stamp in the passport.  They rejected it and said "this is expired".  It's not...she entered the country six weeks ago.  (It's valid for 12 months.)  So I could have called, tried to find the person, and "educated" them.  Maybe they would have been happy to have the explanation and learn something.  Maybe they would have reacted badly.

 

Since I knew her I-551 (the physical green card) was on the way, I just waited until it got here and sent a copy of it instead.  I didn't try to explain anything...just submitted the document.

 

You can certainly try again, but they know what the physical green card looks like and how to read it.  I'd wait if you can.
