Ir1 refused under section 221(g)

Hello! Members. 
 

i had my interview and it went very bad and the consular officer was kind of mean to me, she asked me few questions where did you meet your wife and when ect… and i answered her with honesty i told her my wife travelled once and stayed with me for one month but she couldn’t stay because of her illness and that was serious she couldn’t stay with me and then she told me to give her photos she started to look at the pictures and she said is that what you have i don’t believe in it and its a fraudulent, that was shocking for me and she mentioned another thing she said and your wife don’t make enough income after all that i tried to explain but she said the interview is over then she gave me my passport with a white sheet as public charge marked on the papIMG_7200.thumb.jpeg.203ddbc7b75e419a808163e19616023c.jpegIMG_7200.thumb.jpeg.203ddbc7b75e419a808163e19616023c.jpegIMG_7201.thumb.jpeg.24b5940645b0243243a0d0edec502325.jpegers

Looks like they believe you'd become public charge and are asking for joint sponsor. 

What does your wife make currently? You mentioned her illness, is she not working and on SSI SSDI? Morocco can be tough.

@milimelo  my wife she’s on disability and sometimes she works and sometimes not, on the nvc stage it was skipped because we asked for expedite and nvc sent the case with all the documents that i provided with her medical letter from doctors and disability payments along with joint sponsor with all taxs and w-2s 27.000 from joint sponsor. The consular officer she told me im giving you anothet chance to send me chat from 2020 to present and another co-sponsor or houshold member income.

The joint sponsor only makes $27k?  The I 864s are not additive, the primary sponsor or the joint sponsor must meet the I864P guidelines for their household size and $27k only meets the amount for a household of 2.

Look like you will need another join sponsor at least with income more than that. For safety, 40k is the goal.

@milimelo the joint sponsor had married filling joint and if he add household income it will be 68,000

Then the joint sponsor’s spouse should fill out an I864A.

If the Consulate Officer said that, then you have much, much bigger problems than a financial sponsor.  I would take this opportunity to provide a LOT of evidence that this is a real marriage.  Good luck.  I hope you succeed.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

CO"s can say what they believe, it can be rough but you met , and married on her 1st and only trip,  that alone is red flag  / C O have called immigrant a liar in the past

 

U need more than a joint sponsor 

u need quality time together

U need the USC to prove she has researched the cost of health care insurance in her state and she can afford it till you have a job that has company insurance /  joint sponsor does not have to pay for this- joint sponsor is liable to reimberse governement if u get government benefits

U need to do as embassy asks ,    Casa has  asked in the  for chats and they  say chats from 2020 to present (they want all  not just a section  or a few-Casa wants all of them as others Moroccans have discovered). USC  needs to comply 

 

and all that still does not mean u will be issued a visa i had 5 trips and spent 9 months in Morocc to finally be OK

 

obvious u started chatting sometime in 2020 but did not met in person as that was covid year  and wife's illness was used to expedite to embassy 

 

Wife's illness does not help your case

marrying on 1st trip is a big NO NO for high fraud countries 

Income is not within proverty guideline chart

 

believe me,  I would like u 2 to be successful but do not be surprised to get notice of NOID as CO already said marriage is not bona fida (in her opinion but that is all that counts in an immigration interview)

 

follow advice and meet more /prove your marriage is for the right reasons that is love 

and be ready to refile with a qualified joint sponsor-USC or LPR

 The joint sponsor (or the joint sponsor and his or her household) must reach the 125% income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement.
