Will I get in-state tuition if my family based form I-130 is pending?

I am a student on F-1 visa. My father has a green card and will file I-130 for me. Will that serve as a proof of residency for tuition purposes, knowing that my sponsor (sibling) is an Ohio resident? Or should I wait to get the application approved to get in-state tuition. Also Will I be eligible for financial aid?

A school advisor should be able to answer these questions.  I don't think an I-130 is proof of residency.

Only nonresident aliens who are U.S. nationals, residents of Canada, Mexico and South Korea; or residents of India who were students or business apprentices can have a qualifying dependent.

Can F-1 students be considered residents?

 

 

No. An F1 visa is a student visa and is only valid for a specific reason and for a specific amount of time. This prohibits an F1 visa holder from establishing Residency for Tuition Purposes. For more information, please contact the International Education Center.

Can't see how, particularly as you won't have your immigrant visa by the time you've finished your studies if your father hasn't applied for you yet (unless your studies will be for a decade or more of course!). 

 

But you'd need to ask the school as each will have their own rules. We asked the same question as we assumed we'd be moving on temp visas and have our immigrant visa applications underway when my daughter started college, and were told that we'd need to pay international rates. As it turns out, we got our 'green cards' much quicker than expected, and she's decided to go back to the UK for uni anyway, but hey!

Filing an I 130 is to obtain residency so the very opposite of having residency.
