aos & name change after marriage.

We filed AOS and were wondering when we can have my spouse's name changed to her new married name? Can the name change be requested at the interview for the AOS? What if the permanent resident card is issued without an interview, how would we go about changing name? We also applied for the EAD and parole; what about in these cases?

We checked with Social Security and they cannot change the name until she is in the "system". Our AOS was received on June 24 and NOA was generated on June 29, 2007. Had Biometrics on July 12th. Our case still does not show up in the "system". :huh:

You should have used you spouse's new name on the AOS forms - that's the easiest way to do it. You can't request a name change at the AOS interview. When you get your green card with the old name, you will need to file an I-90 to request a card with the married name. The fee for I-90 is $290.

SSA won't change the name until they see a corrected green card or another USCIS document (EAD):

Jetson, I went to Social Security Administration to changed my Last name..I brought my Marriage Certificate and other documents after one week I received my second SSN card by mail..with new last name. They didn't ask me to provide Green card.

What "other documents" did you show them?

The OP filed AOS in maiden name, so there will be maiden name in the system.

It took me almost a year to change my last name. SSA insisted on a corrected I-94 or another immigration document. Nobody at the local office knew anything about correcting the name on I-94. They kept sending me to the Consulate to change my passport (impossible in my case) and one IO suggested I file I-539 (!!!!!!!!) and request a name change. Ridiculous. I filed the I-539 by the way - wasted $200 and 6 months of my time - only to get a response that I-539 is for the change of non-immigrant status, not name. Doh.
