I am annulled and has a US visa a year prior- does my son and my surname need to match

I got my US Visa as a married woman, got annulled and gave birth to a newborn. 

 

Since my son now has my maiden surname  as his surname (he has no middle name), will I have an issue getting him a us visa via drop box?

Married Name

Lady (First Name)

Bastido (Middle name or father's surname)

Cendana (husband's last name) 

 

Name after annulment

Lady (first name)

Beatrize (my mother's maiden surname)

Bastido (Father's surname)
 

Since I am not married to the father of my son he has my maiden surname as his surname:

 

Rylee Bastido (no middle name)

 

1. Do I need to apply for a passport with back to my maiden name so I could match my son's last name or since my US visa has Bastido as middle name- will that suffice?

I am not sure anyone can answer that all you can do is apply and see.

 

I can think of a few potential issues but they would very much depend on the circumstances.

I am assuming this is the Philippines(???) based on the circumstances and usage of middle names.  My wife and stepdaughter have the same name situation, although it was not for a tourist visa or drop box application.  Stepdaughter has no middle name and she has mom's middle name (grandma's surname) as her surname. I am sure that is not an uncommon name situation in the Philippines for a variety of reasons. In our case, and on an immigrant visa, not a B2 visa, US Embassy Manila never even questioned it in the slightest.   We were prepared to document and explain it but they never even brought it up.   To date, there has never been the slightest question traveling internationally or arriving in the US from overseas trips where the daughter has mom's middle name as her surname.  I wouldn't want to predict any particular outcome but I would speculate that US Embassy Manilla sees that so often they would easily figure it out and would not see it as unusual.  However, whether or not it would make a difference on a B2 dropbox visa application I could not even guess.

  • October 05, 2021: Interview at US Embassy Manila. Verbally approved by US Consul. Positive interview experience.
  • October 05, 2021: CEAC status changed to "Issued"
  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.
