Approved IR1 But May Need to Delay Move (Merged topics)

My husband and I are in a very sad and unfortunate situation where he might not be able to move before his IR-1 visa expires. I’m absolutely heartbroken and so anxious about it, but right now I’m just trying to explore our options.

 

If his visa expires, can he he reapply? We would probably be looking to move in 2 years, so I’d probably start a new application right away. Will that look suspicious? Do we have to file the full I-130 again or can we just do the NVC/medical/interview loop?

 

If we go this route we will talk to an attorney, but I’m just trying to explore our options right now

Is this because of the unvested equity package? If so, the simplest way would be to fly to US and get passport stamped.  Have the green card mailed to someone in the US and send by Fedex/UPS to London.

 

When he is able to stay for 2 months (within the year), come back and apply for re-entry permit, wait for biometrics, leave again.

 

Keep doing that and filing US tax returns.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What was the purpose of getting the IR-1 visa if the intent was not to move?

Things like that will happen if you are trying to play the system.

Situations change and the unexpected happens. It's stressful and disheartening. I doubt the OP is "playing the system".

You've been given a way to avoid starting over, if you can actually make that work.  Starting over will not look suspicious.  The next I-130 will ask if you filed a petition before.  Answer and explain.  No problem.
