Can I Apply for Social Security After I Already stated that I wanted to apply through green card application

So I understand that I can apply for the SSN through the green card application since that's the option I chose. I also checked the box to apply for the SSN on the work authorization application, but basically it's taking too long for the green card approval and we really need the SSN for a few important things. So I'm considering just applying for a SSN directly on the social security website. Will this get me a SSN faster than through waiting for the green card? At this point it has almost been a full year we have been waiting.

Thread is moved from the K-1 Process forum to the Social Security Numbers subforum -- topic involves the SSN.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you entered the US with a K1 visa, you must have one of the following to be able to get SSN --

  • Unexpired I-94 record (ie, K1 admission class AND "Admit Until Date" not passed), or
  • EAD card, or
  • GC

I-485 or I-765 receipt notice would not be acceptable proof of status to apply for SSN in person.

So if I decide to just bypass the SSN processing through applying for the GC and just apply for SSN in person, then would that potentially slow down the SSN processing? I currently don't know what the progress is on the SSN processing through the GC.

No.

If you can apply for SSN independently of GC, this may be faster than waiting for one via GC.

Okay thanks. And I do have the i94 but I think it's past the "Admit Until" date. Does this mean they won't accept it at the SS office if I apply for the SSN directly?

You can’t bypass it. Unfortunately you missed your window to apply for an SSN when you first came on a K1. Now that your I-94 is expired, you will only get an SSN once you have either an EAD or GC in hand. There is no other way to get an SSN - they will not send you a SSN while you are waiting for a GC or EAD to be adjudicated. You can only get one once they’re approved. You need the actual cards if you choose to go in person to apply for an SSN.

Correct. As I mentioned, you have to have the actual green card (I-551) or an EAD card.

For any future K1s who come to the US, please please apply as soon you get here, like literally within a week of arriving. SSA office will not issue an SSN after day 75 of the 90 day window so it is imperative to apply for one ASAP. You don’t have to be married to apply for one.
