Hi! All,

God's Blessings on all of us !!!

Well, it's been awhile since my last visit and everything is going fine for Shely and me. Shely is working, driving her own car, and making plans for bringing family members from Philippines to USA. God is Good!!!

My questions concerns a friend of ours who is in USA temporarily on a B1 Visa for Work to care for her employer who is visiting USA from Greece. Our friend's employer has returned to Greece and our friend has remained behind on her own. Our friend's B1 Visa expires this September but our friend wishes to remain in USA. Is there anyway for our friend to remain in USA? Who can they speak to for legal information? Any suggestions? First steps to take? Our friend only has B1 Visa and their passport at this time. We dearly wish for them to remain in USA legally. Any help would be deeply appreciated!

Hopefully they will do it legally. Many don't. That's why it can be so difficult to get the visas at many embassys.

A B1 is not dual intent. There is no way to adjust on a B1 with no other extenuating circumstances involved.

The only way apart from extending his B1 is to look for a job here and get someone to sponsor him for a H1-B, not easy, hard to get it. I tried to get a job to stay here with my boyfriend for almost a year and then we decided to get married because it was too hard, too heart-breaking to get job offers and then have them call back weeks later saying they couldn't get a work permit.

It all depends on his career field. Some are easier than other.

There is also the possibility to study here which would give him more time and more options when it comes to finding a job.

The one good thing is that he is here on a VISA, meaning that he can adjust to an other visa without having to leave the country (or so my lawyer told me when I asked about my options back then).

Correct! A B-1 is basically a visitors visa (a visit to to business). You cannot switch to a work visa from a visitors visa. If they OP's friend wants to get a work visa they will have to find a company willing to sponsor them, return home and wait for the visa to be approved.

First its a B-1, now its an H-1B? You said their employer returned to Greece? How are they here on a H-1B then? Are they employed right now by a US employer? If so then they can continue that employment and try to apply for a work based Green Card (if their employer sponsored them for one, or they were a internation star in their field and could get "exceptional person" green card). If they have lost their job, then they can't adjust because their H-1B is now invalid and they are out of status. You can't get a work based Green Card if you have been out of status.
